  1                      A bill to be entitled

  2         An act relating to municipal annexation;

  3         amending s. 171.0413, F.S.; excluding

  4         state-owned land from certain municipal

  5         annexation procedures; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (5) of section 171.0413, Florida

11  Statutes, is amended to read:

12         171.0413  Annexation procedures.--Any municipality may

13  annex contiguous, compact, unincorporated territory in the

14  following manner:

15         (5)  If more than 70 percent of the land in an area

16  proposed to be annexed is owned by individuals, corporations,

17  or legal entities which are not registered electors of such

18  area, such area shall not be annexed unless the owners of more

19  than 50 percent of the land in such area, excluding

20  state-owned land, consent to such annexation. Such consent

21  shall be obtained by the parties proposing the annexation

22  prior to the referendum to be held on the annexation.

23         Section 2.  This act shall take effect July 1, 2007.
