8 | department to submit a report to the Governor and |
9 | Legislature; providing an effective date. |

11 | Be It Enacted by the Legislature of the State of Florida: |
12 |

13 | Section 1. Subsection (4) of section 394.461, Florida |
14 | Statutes, is renumbered as subsection (5), and a new subsection |
15 | (4) is added to that section to read: |
16 | 394.461 Designation of receiving and treatment |
17 | facilities.--The department is authorized to designate and |
18 | monitor receiving facilities and treatment facilities and may |
19 | suspend or withdraw such designation for failure to comply with |
20 | this part and rules adopted under this part. Unless designated |
21 | by the department, facilities are not permitted to hold or treat |
22 | involuntary patients under this part. |
23 | (4)(a) A facility designated as a public receiving or |
24 | treatment facility under this section shall report to the |
25 | department on an annual basis the following data, unless these |
26 | data are currently being submitted to the Agency for Health Care |
27 | Administration: |
28 | 1. Number of licensed beds. |
29 | 2. Number of contract days. |
30 | 3. Number of admissions by payer class and diagnoses. |
31 | 4. Number of bed days by payer class. |
32 | 5. Average length of stay by payer class. |
33 | 6. Total revenues by payer class. |
34 | (b) For the purposes of this subsection, "payer class" |
35 | means Medicare, Medicare HMO, Medicaid, Medicaid HMO, private- |
36 | pay health insurance, private-pay health maintenance |
37 | organization, private preferred provider organization, the |
38 | Department of Children and Family Services, other government |
39 | programs, self-pay patients, and charity care. |
40 | (c) The data required under this subsection shall be |
41 | submitted to the department no later than 90 days following the |
42 | end of the facility's fiscal year. A facility designated as a |
43 | public receiving or treatment facility shall submit its initial |
44 | report for the 6-month period ending June 30, 2008. |
45 | (d) The department shall issue an annual report based on |
46 | the data required under this subsection. The report shall |
47 | include data for individual facilities as well as statewide |
48 | totals. The report shall be submitted to the Governor, the |
49 | President of the Senate, and the Speaker of the House of |
50 | Representatives. |
51 | Section 2. This act shall take effect July 1, 2007. |
