A bill to be entitled
2An act relating to mental health facilities; amending s.
3394.461, F.S.; requiring mental health receiving and
4treatment facilities designated by the Department of
5Children and Family Services to report certain financial
6and health service data to the department; providing a
7definition; providing reporting deadlines; requiring the
8department to submit a report to the Governor and
9Legislature; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Subsection (4) of section 394.461, Florida
14Statutes, is renumbered as subsection (5), and a new subsection
15(4) is added to that section to read:
16     394.461  Designation of receiving and treatment
17facilities.--The department is authorized to designate and
18monitor receiving facilities and treatment facilities and may
19suspend or withdraw such designation for failure to comply with
20this part and rules adopted under this part. Unless designated
21by the department, facilities are not permitted to hold or treat
22involuntary patients under this part.
23     (4)(a)  A facility designated as a public receiving or
24treatment facility under this section shall report to the
25department on an annual basis the following data, unless these
26data are currently being submitted to the Agency for Health Care
27Administration:
28     1.  Number of licensed beds.
29     2.  Number of contract days.
30     3.  Number of admissions by payer class and diagnoses.
31     4.  Number of bed days by payer class.
32     5.  Average length of stay by payer class.
33     6.  Total revenues by payer class.
34     (b)  For the purposes of this subsection, "payer class"
35means Medicare, Medicare HMO, Medicaid, Medicaid HMO, private-
36pay health insurance, private-pay health maintenance
37organization, private preferred provider organization, the
38Department of Children and Family Services, other government
39programs, self-pay patients, and charity care.
40     (c)  The data required under this subsection shall be
41submitted to the department no later than 90 days following the
42end of the facility's fiscal year. A facility designated as a
43public receiving or treatment facility shall submit its initial
44report for the 6-month period ending June 30, 2008.
45     (d)  The department shall issue an annual report based on
46the data required under this subsection. The report shall
47include data for individual facilities as well as statewide
48totals. The report shall be submitted to the Governor, the
49President of the Senate, and the Speaker of the House of
50Representatives.
51     Section 2.  This act shall take effect July 1, 2007.
