3     Amendment (with title amendment)
4     Remove lines 42-62 and insert:
5the Department of Highway Safety and Motor Vehicles, which
6shall:
7     1.  Record a penalty of 3 three points on the violator's
8driver's license pursuant to the point system established by s.
9322.27; and
10     2.  Revoke the driver's license of the violator for 1 year.
11A hearing may be requested pursuant to s. 322.271.
12     (c)1.  Any person who dumps litter in violation of
13subsection (4) in an amount exceeding 500 pounds in weight or
14100 cubic feet in volume or in any quantity for commercial
15purposes, or dumps litter which is a hazardous waste as defined
16in s. 403.703, commits is guilty of a felony of the third
17degree, punishable as provided in s. 775.082 or s. 775.083.
18Further, if the violation involves the use of a motor vehicle,
19upon a finding of guilt, whether or not adjudication is withheld
20or whether imposition of sentence is withheld, deferred, or
21suspended, the court shall forward a record of the finding to
22the Department of Highway Safety and Motor Vehicles, which
23shall:
24     a.  Record a penalty of 3 points on the violator's driver's
25license pursuant to the point system established by s. 322.27;
26and
27     b.  Revoke the driver's license of the violator for 1 year.
28A hearing may be requested pursuant to s. 322.271.
29     2.  In addition, the court may order the violator to:
30     a.1.  Remove or render harmless the litter that he or she
31dumped in violation of this section;
32     b.2.  Repair or restore property damaged by, or pay damages
33for any damage arising out of, his or her dumping litter in
34violation of this section; or
35     c.3.  Perform public service relating to the removal of
36litter dumped in violation of this section or to the restoration
37of an area polluted by litter dumped in violation of this
38section, within the same municipality or, if the violation is
39committed in an unincorporated area, the same county as that in
40which the offense was committed.
