14 On page 22, between lines 5 and 6,

16 insert:
17 Section 6. Paragraph (c) of subsection (1) of section
18 125.0103, Florida Statutes, is amended to read:
19 125.0103 Ordinances and rules imposing price controls;
20 findings required; procedures.--
21 (1)
22 (c) Counties must establish maximum rates which may be
23 charged on the towing of vehicles from or immobilization of
24 vehicles on private property, removal and storage of wrecked
25 or disabled vehicles from an accident scene or for the removal
26 and storage of vehicles, in the event the owner or operator is
27 incapacitated, unavailable, leaves the procurement of wrecker
28 service to the law enforcement officer at the scene, or
29 otherwise does not consent to the removal of the vehicle.
30 However, if a municipality chooses to enact an ordinance
31 establishing the maximum fees for the towing or immobilization

1 of vehicles as described in paragraph (b), the county's
2 ordinance shall not apply within such municipality. Except as
3 provided by a municipality, the rates for a county that has
4 not established rates shall be the rates established for the
5 wrecker operator system of the Division of Florida Highway
6 Patrol of the Department of Highway Safety and Motor Vehicles
7 under s. 321.051.
8 Section 7. Paragraph (c) of subsection (1) of section
9 166.043, Florida Statutes, is amended to read:
10 166.043 Ordinances and rules imposing price controls;

21 However, if a municipality chooses to enact an ordinance
22 establishing the maximum fees for the towing or immobilization
23 of vehicles as described in paragraph (b), the county's
24 ordinance established under s. 125.0103 shall not apply within
25 such municipality. Unless provided by the county, in a
26 municipality that has not established rates, the rates shall
27 be the rates established for the wrecker operator system of
28 the Division of Florida Highway Patrol of the Department of
29 Highway Safety and Motor Vehicles under s. 321.051.
