  1                      A bill to be entitled

  2         An act relating to cellular telephone use;

  3         creating s. 316.305, F.S.; prohibiting the use

  4         of a cellular telephone while operating a motor

  5         vehicle; providing an enhanced penalty for a

  6         violation that occurs in a posted school zone;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 316.305, Florida Statutes, is

12  created to read:

13         316.305  Use of cellular telephones; enhanced

14  penalties.--

15         (1)  A person may not operate a cellular telephone

16  while driving a motor vehicle on a road, street, or highway of

17  this state.

18         (2)(a)  A violation of this section is a noncriminal

19  traffic infraction, punishable as a nonmoving violation as

20  provided in chapter 318.

21         (b)  A person who violates paragraph (a) in a motor

22  vehicle that is within a lawfully posted school zone shall pay

23  a fine that is double the amount provided in chapter 318 for a

24  violation of paragraph (a).

25         Section 2.  This act shall take effect July 1, 2007.

28                          SENATE SUMMARY

29    Prohibits drivers from operating a vehicle while using a
      cellular telephone. Doubles the penalty for a violation
30    that occurs in a posted school zone.
