5 Census Bureau address information held by an
6 agency; providing an exception to the
7 exemption; authorizing access to other
8 confidential or exempt information; providing
9 for future review and repeal of the exemption;
10 providing a statement of public necessity;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (g) is added to subsection (1) of
16 section 119.071, Florida Statutes, to read:
17 119.071 General exemptions from inspection or copying
18 of public records.--
19 (1) AGENCY ADMINISTRATION.--
20 (g)1. United States Census Bureau address information,
21 including maps showing structure location points, agency
22 records verifying addresses, and agency records identifying
23 address errors or omissions, which is held by an agency
24 pursuant to the Local Update of Census Addresses Program,
25 Title XIII of the United States Code, is confidential and
26 exempt from s. 119.07(1) and s. 24(a), Art. I of the State
27 Constitution.
28 2. Such information may be released to another agency
29 or governmental entity in the furtherance of its duties and
30 responsibilities under the Local Update of Census Addresses
31 Program.

1 3. An agency performing duties and responsibilities
2 under the Local Update of Census Addresses Program shall have
3 access to any other confidential or exempt information held by
4 another agency if such access is necessary in order to perform
5 its duties and responsibilities under the program.
6 4. This exemption is subject to the open Government
7 Sunset Review Act in accordance with s. 119.15 and shall stand
8 repealed October 2, 2012, unless reviewed and saved from
9 repeal through reenactment by the Legislature.
10 Section 2. The Legislature finds that it is a public
11 necessity that United States Census Bureau address
12 information, including maps showing structure location points,
13 agency records verifying addresses, and agency records
14 identifying address errors or omissions, which is held by an
15 agency be made confidential and exempt from public-records
16 requirements. Pursuant to the Local Update Census Addresses
17 Program, Title XIII of the United States Code, United States
18 Census Bureau address information must be kept confidential.
19 Further, all individuals directly involved in reviewing such
20 information and any individuals who have access to such
21 information are required to sign a confidentiality agreement
22 to preserve the confidentiality of the address information.
23 Without this exemption, agencies would be prevented from
24 participating in the program. As such, the effective and
25 efficient administration of the Local Update Census Addresses
26 Program would be hindered at the federal level. Further, it
27 could result in a negative fiscal impact on the state.
28 Section 3. This act shall take effect upon becoming a
29 law.
