1 A bill to be entitled
2 An act relating to the Florida Birth-Related
3 Neurological Injury Compensation Association;
4 amending s. 766.315, F.S.; providing for the
5 appointment of additional representatives to
6 the board of directors of the association;
7 providing one new representative from the Board
8 of Medicine and one new representative from the
9 Board of Osteopathic Medicine; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (1) and paragraph (a) of
15 subsection (2) of section 766.315, Florida Statutes, are
16 amended to read:
17 766.315 Florida Birth-Related Neurological Injury
18 Compensation Association; board of directors.--
19 (1)(a) The Florida Birth-Related Neurological Injury
20 Compensation Plan shall be governed by a board of seven five
21 directors which shall be known as the Florida Birth-Related
22 Neurological Injury Compensation Association. The association
23 is not a state agency, board, or commission. Notwithstanding
24 the provision of s. 15.03, the association is authorized to
25 use the state seal.
26 (b) The directors shall be appointed for staggered
27 terms of 3 years or until their successors are appointed and
28 have qualified.
29 (c)1. Five The directors shall be appointed by the
30 Chief Financial Officer as follows:
31 a.1. One citizen representative.

1 b.2. One representative of participating physicians.
2 c.3. One representative of hospitals.
3 d.4. One representative of casualty insurers.
4 e.5. One representative of physicians other than
5 participating physicians.
6 2. Two directors shall be appointed by the chair of
7 the respective board as follows:
8 a. One member of the Board of Medicine.
9 b. One member of the Board of Osteopathic Medicine.
10 (2)(a) The Chief Financial Officer may select the
11 representative of the participating physicians from a list of
12 at least three names to be recommended by the Florida
13 Obstetric and Gynecologic Society; the representative of
14 hospitals from a list of at least three names to be
15 recommended by the Florida Hospital Association; the
16 representative of casualty insurers from a list of at least
17 three names, one of which is recommended by the American
18 Insurance Association, one by the Alliance of American
19 Insurers, and one by the National Association of Independent
20 Insurers; and the representative of physicians other than
21 participating physicians from a list of three names to be
22 recommended by the Florida Medical Association and a list of
23 three names to be recommended by the Florida Osteopathic
24 Medical Association. In no case shall the Chief Financial
25 Officer be bound to make any appointment from among the
26 nominees of such respective associations. The representative
27 from the Board of Medicine and the representative from the
28 Board of Osteopathic Medicine shall be appointed by the chair
29 of each respective board.
30 Section 2. This act shall take effect upon becoming a
31 law.
