9     Between line(s) 146 and 147 insert:
10     Section 5.  Paragraph (f) of subsection (4) of section
111001.42, Florida Statutes, is amended to read:
12     1001.42  Powers and duties of district school board.--The
13district school board, acting as a board, shall exercise all
14powers and perform all duties listed below:
15     (4)  ESTABLISHMENT, ORGANIZATION, AND OPERATION OF
16SCHOOLS.--Adopt and provide for the execution of plans for the
17establishment, organization, and operation of the schools of the
18district, including, but not limited to, the following:
19     (f)  Opening and closing of schools; fixing uniform
20date.--Adopt policies for the opening and closing of schools and
21fix uniform dates.; however, Beginning with the 2007-2008 school
22year, the opening date of the school year for schools in the
23district may not be earlier than 14 days before Labor Day each
24year. However, beginning with the 2008-2009 school year, a
25district school board may with a super majority vote after
26holding at least two public meetings that begin no earlier than
276 p.m. establish an earlier opening date for students that is no
28earlier than the first week in August or a different opening
29date for a school that operates on a year-round or extended
30calendar.
