  1                      A bill to be entitled

  2         An act relating to the human papillomavirus;

  3         requiring public and private middle schools in

  4         the state to provide to certain students and

  5         their parents or guardians information

  6         concerning the human papillomavirus, its

  7         vaccine, and cervical cancer; prohibiting

  8         certain students from admission into school

  9         without providing evidence of vaccination for

10         the human papillomavirus; providing an

11         exception; prohibiting a principal from

12         knowingly admitting a student into school

13         without evidence of vaccination for the human

14         papillomavirus; providing an exception;

15         requiring the Department of Education, in

16         consultation with the Department of Health, to

17         prescribe the content of the information

18         regarding the connection between the human

19         papillomavirus and cervical cancer and the

20         availability of a vaccine preventing human

21         papillomavirus; providing an effective date.

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  (1)  Beginning with the 2008-2009 school

26  year, each public or private middle school in this state shall

27  provide to each student who is 11 years of age or 12 years of

28  age and to the parents or guardian of such student information

29  concerning the connection between the human papillomavirus

30  (HPV) and cervical cancer and the availability of a vaccine

31  preventing human papillomavirus.

 1         (2)  Beginning with the 2008-2009 school year:

 2         (a)  A student who is 11 years of age or 12 years of

 3  age may not be admitted to any private or public school in

 4  this state until that student submits to the school acceptable

 5  evidence of vaccination for the human papillomavirus or proof

 6  that, after receiving the information required in subsection

 7  (1), the student's parent or guardian has elected that the

 8  student not receive the vaccine.

 9         (b)  A principal or any other person in charge of a

10  public or private school may not knowingly admit a student who

11  is 11 years of age or 12 years of age until that student

12  submits to the school acceptable evidence of vaccination for

13  the human papillomavirus or proof that, after receiving the

14  information required in subsection (1), the student's parent

15  or guardian has elected that the student not receive the

16  vaccine.

17         (3)  The Department of Education, in consultation with

18  the Department of Health, shall prescribe the content of the

19  information required in subsection (1).

20         Section 2.  This act shall take effect July 1, 2008.

23                          SENATE SUMMARY

24    Requires public and private middle schools in the state
      to provide information to students who are 11 and 12
25    years of age and their parents concerning the human
      papillomavirus, its vaccine, and cervical cancer.
26    Prohibits those students from being admitted into school
      without evidence of vaccination for human papillomavirus.
27    Provides that a principal may not knowingly admit certain
      students into school without evidence of vaccination for
28    the human papillomavirus. Provides exceptions. Requires
      the Department of Education, in consultation with the
29    Department of Health, to prescribe the content of the
      information regarding the connection between the human
30    papillomavirus and cervical cancer and the availability
      of a human papillomavirus vaccine.
