5 | Section 4. Effective upon this act becoming a law, |
6 | subsection (5) is added to section 163.31801, Florida Statutes, |
7 | to read: |
8 | 163.31801 Impact fees; short title; intent; definitions; |
9 | ordinances levying impact fees.-- |
10 | (5)(a) A local government may not increase an existing |
11 | impact fee in any single fiscal year by more than the percentage |
12 | change in the Consumer Price Index for all urban consumers, U.S. |
13 | City Average, all items 1982-1984=100, or successor reports for |
14 | the 12-month period through June prior to the beginning of the |
15 | fiscal year, as initially reported by the United States |
16 | Department of Labor, Bureau of Labor Statistics. |
17 | (b) The total of all impact fees collected by a local |
18 | government on a construction project shall equal no more than 5 |
19 | percent of the actual cost of construction. |
20 | Section 5. Notwithstanding the provisions of any general |
21 | or special law, if any provision of general or special law |
22 | conflicts with the provisions of this act, the provisions of |
23 | this act shall preempt, control, and supersede such provision of |
24 | general or special law to the extent of the conflict. |
25 | Section 6. Except as otherwise expressly provided in this |
26 | act, this act shall take effect July 1, 2007. |
