1 A bill to be entitled
2 An act relating to a review under the Open
3 Government Sunset Review Act; amending s.
4 121.4501, F.S.; revising an exemption from
5 public-records requirements which is provided
6 for information that identifies participants in
7 the Public Employee Optional Retirement
8 Program; saving the exemption from repeal under
9 the Open Government Sunset Review Act; deleting
10 the provision that provides for the repeal of
11 the exemption; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (19) of section 121.4501,
16 Florida Statutes, is amended to read:
17 121.4501 Public Employee Optional Retirement
18 Program.--
19 (19) PARTICIPANT RECORDS.--All Personal identifying
20 information of regarding a participant in the Public Employee
21 Optional Retirement Program contained in Florida Retirement
22 System records held by the State Board of Administration or
23 the Department of Management Services, or their agents,
24 employees, or contractors is exempt from the provisions of s.
25 119.07(1) and s. 24(a), Art. I of the State Constitution. The
26 department or board may use such exempt information as
27 necessary in any legal or administrative proceeding. This
28 subsection is subject to the Open Government Sunset Review Act
29 of 1995 in accordance with s. 119.15, and shall stand repealed
30 October 2, 2007, unless reviewed and saved from repeal through
31 reenactment by the Legislature.

1 Section 2. This act shall take effect October 1, 2007.

4 SENATE SUMMARY
5 Revises an exemption from the public-records law which is
provided for personal identifying information of
6 participants in the Public Employee Optional Retirement
Program. Removes the repeal of the exemption which is
7 scheduled to occur on October 2, 2007, under the Open
Government Sunset Review Act.
