2 An act relating to agents of the Department of
3 Highway Safety and Motor Vehicles; amending s.
4 320.03, F.S.; providing duties of license tag
5 agents with respect to issuing vehicle
6 registrations, license plates, and validation
7 stickers; requiring that such agents keep
8 certain records; prohibiting an employee of a
9 tax collector or license tag agent from
10 contracting with or being employed by certain
11 entities that process titles or registrations
12 for motor vehicles; amending s. 328.73, F.S.;
13 providing duties of license tag agents with
14 respect to issuing vessel registrations and
15 vessel numbers and decals; requiring that such
16 agents keep certain records and promptly remit
17 moneys to the department; prohibiting an
18 employee of a tax collector or license tag
19 agent from contracting with or being employed
20 by certain entities that process titles or
21 registrations for vessels; providing an
22 effective date.

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. Subsections (1) and (3) of section 320.03,
27 Florida Statutes, are amended, and subsection (10) is added to
28 that section, to read:
29 320.03 Registration; duties of tax collectors;

1 (1) The tax collectors or license tag agents in the
2 several counties of the state, as authorized agents of the
3 department, shall issue registration certificates,
4 registration license plates, validation stickers, and mobile
5 home stickers to applicants, subject to the requirements of
6 law, in accordance with rules of the department. Any person,
7 firm, or corporation representing itself, through advertising
8 or naming of the business, to be an authorized agent of the
9 department shall be deemed guilty of an unfair and deceptive
10 trade practice as defined in part II of chapter 501. No Such
11 person, firm, or corporation may not shall use either the
12 state or county name as a part of their business name when
13 such use can reasonably be interpreted as an official state or
14 county office.
15 (3) Each tax collector or license tag agent shall keep
16 a full and complete record and account of all validation
17 stickers, mobile home stickers, or other properties received
18 by him or her from the department, or from any other source.
19 Notwithstanding chapter 116, every county officer within this
20 state authorized to collect funds provided for in this chapter
21 shall pay all sums officially received by the officer into the
22 State Treasury no later than 5 working days after the close of
23 the business day in which the officer received the funds.
24 Payment by county officers to the state shall be made by means
25 of electronic funds transfer.
26 (10) An employee of a tax collector or license tag
27 agent may not contract with or be employed by any entity that,
28 in the normal course of its business, prepares the
29 applications for or requests the processing of motor vehicle
30 titles or registrations.

1 Section 2. Section 328.73, Florida Statutes, is
2 amended to read:
3 328.73 Registration; duties of tax collectors.--
4 (1) The tax collectors or license tag agents in the
5 counties of the state, as authorized agents of the department,
6 shall issue registration certificates and vessel numbers and
7 decals to applicants, subject to the requirements of law and
8 in accordance with rules of the department.
9 (2) Each tax collector or license tag agent shall keep
10 a full and complete record and account of all vessel decals or
11 other properties received by him or her from the department or
12 from any other source and shall make prompt remittance of
13 moneys collected by him or her at the times and in the manner
14 prescribed by law.
15 (3) A fee of 50 cents shall be charged in addition to
16 the fees required under s. 328.72 on every vessel decal
17 registration sold to cover the cost of the Florida Real Time
18 Vehicle Information System. The fees collected under this
19 section shall be deposited into the Highway Safety Operating
20 Trust Fund and shall be used to fund that system and may be
21 used to fund the general operations of the department.
22 (4) Notwithstanding chapter 116, every county officer
23 within this state authorized to collect funds provided for in
