A bill to be entitled
2An act relating to trust funds; terminating specified
3trust funds within the Department of Education; providing
4for disposition of balances in and revenues of such trust
5funds; prescribing procedures for the termination of such
6trust funds; renaming a trust fund within the department;
7amending s. 1002.335, F.S.; conforming a reference;
8amending s. 1012.72, F.S.; removing a reference, to
9conform; repealing s. 1010.72, F.S., relating to the Dale
10Hickam Excellent Teaching Program Trust Fund; repealing s.
111010.76, F.S., relating to the Educational Aids Trust
12Fund; repealing s. 1010.78, F.S., relating to the
13Projects, Contracts, and Grants Trust Fund; providing
14effective dates.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  (1)  The following trust funds within the
19Department of Education are terminated:
20     (a)  Effective July 1, 2008, the Projects, Contracts, and
21Grants Trust Fund, FLAIR number 48-2-552. Current balances from
22general education development testing and the leasing of
23available transponder time from the state's satellite
24transponder resources in the Projects, Contracts, and Grants
25Trust Fund, and all revenues from general education development
26testing and the leasing of available transponder time from the
27state's satellite transponder resources shall be transferred to
28the Operating Trust Fund within the Department of Education,
29FLAIR number 48-2-510. Current balances from donations remaining
30in the Projects, Contracts, and Grants Trust Fund and all
31revenues from donations shall be transferred to the Grants and
32Donations Trust Fund within the Department of Education, FLAIR
33number 48-2-339.
34     (b)  The Dale Hickam Excellent Teaching Program Trust Fund,
35FLAIR number 48-2-206. All current balances remaining in the
36Dale Hickam Excellent Teaching Program Trust Fund and all
37revenues of the fund shall be transferred to the General Revenue
38Fund.
39     (2)  The Department of Education shall pay any outstanding
40debts and obligations of the terminated funds as soon as
41practicable, and the Chief Financial Officer shall close out and
42remove the terminated funds from various state accounting
43systems using generally accepted accounting principles
44concerning warrants outstanding, assets, and liabilities.
45     Section 2.  The Educational Aids Trust Fund, FLAIR number
4648-2-180, within the Department of Education is renamed the
47Federal Grants Trust Fund, FLAIR number 48-2-261.
48     Section 3.  Paragraph (a) of subsection (3) of section
491002.335, Florida Statutes, is amended to read:
50     1002.335  Florida Schools of Excellence Commission.--
51     (3)  FLORIDA SCHOOLS OF EXCELLENCE COMMISSION.--
52     (a)  The Florida Schools of Excellence Commission is
53established as an independent, state-level charter school
54authorizing entity working in collaboration with the Department
55of Education and under the supervision of the State Board of
56Education. Startup funds necessary to establish and operate the
57commission may be received through private contributions and
58federal and other institutional grants through the Grants and
59Donations Trust Fund and the Federal Grants Educational Aids
60Trust Fund housed within the department in addition to funds
61provided in the General Appropriations Act. The department shall
62assist in securing federal and other institutional grant funds
63to establish the commission.
64     Section 4.  Subsection (5) of section 1012.72, Florida
65Statutes, is amended to read:
66     1012.72  Dale Hickam Excellent Teaching Program.--
67     (5)  The Dale Hickam Excellent Teaching Program Trust Fund
68shall be administered by the Department of Education pursuant to
69s. 1010.72.
70     Section 5.  Sections 1010.72 and 1010.76, Florida Statutes,
71are repealed.
72     Section 6.  Effective July 1, 2008, Section 1010.78,
73Florida Statutes, is repealed.
74     Section 7.  Except as otherwise expressly provided in this
75act, this act shall take effect July 2, 2007.
