10 | Hickam Excellent Teaching Program Trust Fund; repealing s. |
11 | 1010.76, F.S., relating to the Educational Aids Trust |
12 | Fund; repealing s. 1010.78, F.S., relating to the |
13 | Projects, Contracts, and Grants Trust Fund; providing |
14 | effective dates. |

16 | Be It Enacted by the Legislature of the State of Florida: |
17 |

18 | Section 1. (1) The following trust funds within the |
19 | Department of Education are terminated: |
20 | (a) Effective July 1, 2008, the Projects, Contracts, and |
21 | Grants Trust Fund, FLAIR number 48-2-552. Current balances from |
22 | general education development testing and the leasing of |
23 | available transponder time from the state's satellite |
24 | transponder resources in the Projects, Contracts, and Grants |
25 | Trust Fund, and all revenues from general education development |
26 | testing and the leasing of available transponder time from the |
27 | state's satellite transponder resources shall be transferred to |
28 | the Operating Trust Fund within the Department of Education, |
29 | FLAIR number 48-2-510. Current balances from donations remaining |
30 | in the Projects, Contracts, and Grants Trust Fund and all |
31 | revenues from donations shall be transferred to the Grants and |
32 | Donations Trust Fund within the Department of Education, FLAIR |
33 | number 48-2-339. |
34 | (b) The Dale Hickam Excellent Teaching Program Trust Fund, |
35 | FLAIR number 48-2-206. All current balances remaining in the |
36 | Dale Hickam Excellent Teaching Program Trust Fund and all |
37 | revenues of the fund shall be transferred to the General Revenue |
38 | Fund. |
39 | (2) The Department of Education shall pay any outstanding |
40 | debts and obligations of the terminated funds as soon as |
41 | practicable, and the Chief Financial Officer shall close out and |
42 | remove the terminated funds from various state accounting |
43 | systems using generally accepted accounting principles |
44 | concerning warrants outstanding, assets, and liabilities. |
45 | Section 2. The Educational Aids Trust Fund, FLAIR number |
46 | 48-2-180, within the Department of Education is renamed the |
47 | Federal Grants Trust Fund, FLAIR number 48-2-261. |
48 | Section 3. Paragraph (a) of subsection (3) of section |
49 | 1002.335, Florida Statutes, is amended to read: |
50 | 1002.335 Florida Schools of Excellence Commission.-- |
51 | (3) FLORIDA SCHOOLS OF EXCELLENCE COMMISSION.-- |
52 | (a) The Florida Schools of Excellence Commission is |
53 | established as an independent, state-level charter school |
54 | authorizing entity working in collaboration with the Department |
55 | of Education and under the supervision of the State Board of |
56 | Education. Startup funds necessary to establish and operate the |
57 | commission may be received through private contributions and |
58 | federal and other institutional grants through the Grants and |
59 | Donations Trust Fund and the Federal Grants Educational Aids |
60 | Trust Fund housed within the department in addition to funds |
61 | provided in the General Appropriations Act. The department shall |
62 | assist in securing federal and other institutional grant funds |
63 | to establish the commission. |
64 | Section 4. Subsection (5) of section 1012.72, Florida |
65 | Statutes, is amended to read: |
66 | 1012.72 Dale Hickam Excellent Teaching Program.-- |
67 | (5) The Dale Hickam Excellent Teaching Program Trust Fund |
68 | shall be administered by the Department of Education pursuant to |
69 | s. 1010.72. |
70 | Section 5. Sections 1010.72 and 1010.76, Florida Statutes, |
71 | are repealed. |
72 | Section 6. Effective July 1, 2008, Section 1010.78, |
73 | Florida Statutes, is repealed. |
74 | Section 7. Except as otherwise expressly provided in this |
75 | act, this act shall take effect July 2, 2007. |
