A bill to be entitled
2An act relating to trust funds; terminating the Florida
3World War II Veterans Memorial Matching Trust Fund within
4the Department of Veterans' Affairs; providing for the
5disposition of balances in and revenues of the trust fund;
6prescribing procedures for the termination of the trust
7fund; repealing ss. 295.18, 295.181, 295.182, 295.183, and
8295.185, F.S.; repealing the Florida World War II Veterans
9Memorial Matching Trust Fund and related provisions of the
10Florida World War II Veterans Memorial Act to conform to
11the termination of the trust fund; amending s. 17.61,
12F.S.; removing the Community Resources Development Trust
13Fund within the Department of Children and Family Services
14from among enumerated trust funds of the department that
15are not excepted from required investment by the Chief
16Financial Officer; amending s. 20.435, F.S.; removing the
17scheduled termination of the Biomedical Research Trust
18Fund within the Department of Health; providing an
19effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  (1)  The Florida World War II Veterans Memorial
24Matching Trust Fund, FLAIR number 50-2-755, within the
25Department of Veterans' Affairs is terminated.
26     (2)  All current balances remaining in, and all revenues
27of, the trust fund shall be transferred to the Grants and
28Donations Trust Fund within the Department of Veterans' Affairs,
29FLAIR number 50-2-339.
30     (3)  The Department of Veteran's Affairs shall pay any
31outstanding debts and obligations of the terminated fund as soon
32as practicable, and the Chief Financial Officer shall close out
33and remove the terminated fund from the various state accounting
34systems using generally accepted accounting principles
35concerning warrants outstanding, assets, and liabilities.
36     Section 2.  Sections 295.18, 295.181, 295.182, 295.183, and
37295.185, Florida Statutes, are repealed.
38     Section 3.  Paragraph (c) of subsection (3) of section
3917.61, Florida Statutes, is amended to read:
40     17.61  Chief Financial Officer; powers and duties in the
41investment of certain funds.--

43     (c)  Except as provided in this paragraph and except for
44moneys described in paragraph (d), the following agencies shall
45not invest trust fund moneys as provided in this section, but
46shall retain such moneys in their respective trust funds for
47investment, with interest appropriated to the General Revenue
48Fund, pursuant to s. 17.57:
49     1.  The Agency for Health Care Administration, except for
50the Tobacco Settlement Trust Fund.
51     2.  The Agency for Persons with Disabilities, except for:
52     a.  The Federal Grants Trust Fund.
53     b.  The Tobacco Settlement Trust Fund.
54     3.  The Department of Children and Family Services, except
55for:
56     a.  The Alcohol, Drug Abuse, and Mental Health Trust Fund.
57     b.  The Community Resources Development Trust Fund.
58     b.c.  The Refugee Assistance Trust Fund.
59     c.d.  The Social Services Block Grant Trust Fund.
60     d.e.  The Tobacco Settlement Trust Fund.
61     e.f.  The Working Capital Trust Fund.
62     4.  The Department of Community Affairs, only for the
63Operating Trust Fund.
64     5.  The Department of Corrections.
65     6.  The Department of Elderly Affairs, except for:
66     a.  The Federal Grants Trust Fund.
67     b.  The Tobacco Settlement Trust Fund.
68     7.  The Department of Health, except for:
69     a.  The Federal Grants Trust Fund.

90     Section 4.  Paragraph (h) of subsection (1) of section
9120.435, Florida Statutes, is amended to read:
92     20.435  Department of Health; trust funds.--
93     (1)  The following trust funds are hereby created, to be
94administered by the Department of Health:
95     (h)  Biomedical Research Trust Fund.
96     1.  Funds to be credited to the trust fund shall consist of
97funds deposited pursuant to s. 215.5601 and any other funds
98appropriated by the Legislature. Funds shall be used for the
99purposes of the James and Esther King Biomedical Research
100Program and the William G. "Bill" Bankhead, Jr., and David Coley
101Cancer Research Program as specified in ss. 215.5602, 288.955,
102and 381.922. The trust fund is exempt from the service charges
103imposed by s. 215.20.
104     2.  Notwithstanding the provisions of s. 216.301 and
105pursuant to s. 216.351, any balance in the trust fund at the end
106of any fiscal year shall remain in the trust fund at the end of
107the year and shall be available for carrying out the purposes of
108the trust fund. The department may invest these funds
109independently through the Chief Financial Officer or may
110negotiate a trust agreement with the State Board of
111Administration for the investment management of any balance in
112the trust fund.
113     3.  Notwithstanding s. 216.301 and pursuant to s. 216.351,
114any balance of any appropriation from the Biomedical Research
115Trust Fund which is not disbursed but which is obligated
116pursuant to contract or committed to be expended may be carried
117forward for up to 3 years following the effective date of the
118original appropriation.
119     4.  The trust fund shall, unless terminated sooner, be
120terminated on July 1, 2008.
121     Section 5.  This act shall take effect July 1, 2007.
