6     Section 2.  The amendment of s. 201.15, Florida Statutes,
7by this act shall expire July 1, 2012, and the text of that
8section shall revert to that in existence on June 30, 2007,
9except that any amendments to such text enacted other than by
10this act shall be preserved and continue to operate to the
11extent that such amendments are not dependent upon the portions
12of such text which expire pursuant to this section.
13     Section 3.  Subsection (1) of section 403.890, Florida
14Statutes, is amended to read:
15     403.890  Water Protection and Sustainability Program;
16intent; goals; purposes.--
17     (1)  Effective July 1, 2006, revenues transferred from the
18Department of Revenue pursuant to s. 201.15(1)(d)2. shall be
19deposited into the Water Protection and Sustainability Program
20Trust Fund in the Department of Environmental Protection. These
21revenues and any other additional revenues deposited into or
22appropriated to the Water Protection and Sustainability Trust
23Fund shall be distributed by the Department of Environmental
24Protection in the following manner:
25     (a)  Thirty million dollars Sixty percent to the Department
26of Environmental Protection for the implementation of an
27alternative water supply program as provided in s. 373.1961.
28     (b)  Twenty million dollars percent for the implementation
29of best management practices and capital project expenditures
30necessary for the implementation of the goals of the total
31maximum daily loads program established in s. 403.067. Of these
32funds, 85 percent shall be transferred to the credit of the
33Department of Environmental Protection Water Quality Assurance
34Trust Fund to address water quality impacts associated with
35nonagricultural nonpoint sources. Fifteen percent of these funds
36shall be transferred to the Department of Agriculture and
37Consumer Services General Inspection Trust Fund to address water
38quality impacts associated with agricultural nonpoint sources.
39These funds shall be used for research, development,
40demonstration, and implementation of the total maximum daily
41load program under s. 403.067, suitable best management
42practices or other measures used to achieve water quality
43standards in surface waters and water segments identified
44pursuant to s. 303(d) of the Clean Water Act, Pub. L. No. 92-
45500, 33 U.S.C. ss. 1251 et seq. Implementation of best
46management practices and other measures may include cost-share
47grants, technical assistance, implementation tracking, and
48conservation leases or other agreements for water quality
49improvement. The Department of Environmental Protection and the
50Department of Agriculture and Consumer Services may adopt rules
51governing the distribution of funds for implementation of
52capital projects, best management practices, and other measures.
53These funds shall not be used to abrogate the financial
54responsibility of those point and nonpoint sources that have
55contributed to the degradation of water or land areas. Increased
56priority shall be given by the department and the water
57management district governing boards to those projects that have
58secured a cost-sharing agreement allocating responsibility for
59the cleanup of point and nonpoint sources.
60     (c)  Ten million dollars percent shall be disbursed for the
61purposes of funding projects pursuant to ss. 373.451-373.459 or
62surface water restoration activities in water-management-
63district-designated priority water bodies. The Secretary of
64Environmental Protection shall ensure that each water management
65district receives the following percentage of funds annually:
66     1.  Thirty-five percent to the South Florida Water
67Management District;
68     2.  Twenty-five percent to the Southwest Florida Water
69Management District;
70     3.  Twenty-five percent to the St. Johns River Water
71Management District;
72     4.  Seven and one-half percent to the Suwannee River Water
73Management District; and
74     5.  Seven and one-half percent to the Northwest Florida
75Water Management District.
76     (d)  Ten million dollars percent to the Department of
77Environmental Protection for the Disadvantaged Small Community
78Wastewater Grant Program as provided in s. 403.1838.
79     (e)  Beginning June 30, 2007, and every 24 months
80thereafter, the Department of Environmental Protection shall
81request the return of all unencumbered funds distributed
82pursuant to this section. These funds shall be deposited into
83the Water Protection and Sustainability Program Trust Fund and
84redistributed pursuant to the provisions of this section.
85     Section 4.  The amendment of s. 403.890, Florida Statutes,
86by this act shall expire July 1, 2012, and the text of that
87section shall revert to that in existence on June 30, 2007,
88except that any amendments to such text enacted other than by
89this act shall be preserved and continue to operate to the
90extent that such amendments are not dependent upon the portions
91of such text which expire pursuant to this section.
