6 | Section 2. The amendment of s. 201.15, Florida Statutes, |
7 | by this act shall expire July 1, 2012, and the text of that |
8 | section shall revert to that in existence on June 30, 2007, |
9 | except that any amendments to such text enacted other than by |
10 | this act shall be preserved and continue to operate to the |
11 | extent that such amendments are not dependent upon the portions |
12 | of such text which expire pursuant to this section. |
13 | Section 3. Subsection (1) of section 403.890, Florida |
14 | Statutes, is amended to read: |
15 | 403.890 Water Protection and Sustainability Program; |
16 | intent; goals; purposes.-- |
17 | (1) Effective July 1, 2006, revenues transferred from the |
18 | Department of Revenue pursuant to s. 201.15(1)(d)2. shall be |
19 | deposited into the Water Protection and Sustainability Program |
20 | Trust Fund in the Department of Environmental Protection. These |
21 | revenues and any other additional revenues deposited into or |
22 | appropriated to the Water Protection and Sustainability Trust |
23 | Fund shall be distributed by the Department of Environmental |
24 | Protection in the following manner: |
25 | (a) Thirty million dollars Sixty percent to the Department |
26 | of Environmental Protection for the implementation of an |
27 | alternative water supply program as provided in s. 373.1961. |
28 | (b) Twenty million dollars percent for the implementation |
29 | of best management practices and capital project expenditures |
30 | necessary for the implementation of the goals of the total |
31 | maximum daily loads program established in s. 403.067. Of these |
32 | funds, 85 percent shall be transferred to the credit of the |
33 | Department of Environmental Protection Water Quality Assurance |
34 | Trust Fund to address water quality impacts associated with |
35 | nonagricultural nonpoint sources. Fifteen percent of these funds |
36 | shall be transferred to the Department of Agriculture and |
37 | Consumer Services General Inspection Trust Fund to address water |
38 | quality impacts associated with agricultural nonpoint sources. |
39 | These funds shall be used for research, development, |
40 | demonstration, and implementation of the total maximum daily |
41 | load program under s. 403.067, suitable best management |
42 | practices or other measures used to achieve water quality |
43 | standards in surface waters and water segments identified |
44 | pursuant to s. 303(d) of the Clean Water Act, Pub. L. No. 92- |
45 | 500, 33 U.S.C. ss. 1251 et seq. Implementation of best |
46 | management practices and other measures may include cost-share |
47 | grants, technical assistance, implementation tracking, and |
48 | conservation leases or other agreements for water quality |
49 | improvement. The Department of Environmental Protection and the |
50 | Department of Agriculture and Consumer Services may adopt rules |
51 | governing the distribution of funds for implementation of |
52 | capital projects, best management practices, and other measures. |
53 | These funds shall not be used to abrogate the financial |
54 | responsibility of those point and nonpoint sources that have |
55 | contributed to the degradation of water or land areas. Increased |
56 | priority shall be given by the department and the water |
57 | management district governing boards to those projects that have |
58 | secured a cost-sharing agreement allocating responsibility for |
59 | the cleanup of point and nonpoint sources. |
60 | (c) Ten million dollars percent shall be disbursed for the |
61 | purposes of funding projects pursuant to ss. 373.451-373.459 or |
62 | surface water restoration activities in water-management- |
63 | district-designated priority water bodies. The Secretary of |
64 | Environmental Protection shall ensure that each water management |
65 | district receives the following percentage of funds annually: |
66 | 1. Thirty-five percent to the South Florida Water |
67 | Management District; |
68 | 2. Twenty-five percent to the Southwest Florida Water |
69 | Management District; |
70 | 3. Twenty-five percent to the St. Johns River Water |
71 | Management District; |
72 | 4. Seven and one-half percent to the Suwannee River Water |
73 | Management District; and |
74 | 5. Seven and one-half percent to the Northwest Florida |
75 | Water Management District. |
76 | (d) Ten million dollars percent to the Department of |
77 | Environmental Protection for the Disadvantaged Small Community |
78 | Wastewater Grant Program as provided in s. 403.1838. |
79 | (e) Beginning June 30, 2007, and every 24 months |
80 | thereafter, the Department of Environmental Protection shall |
81 | request the return of all unencumbered funds distributed |
82 | pursuant to this section. These funds shall be deposited into |
83 | the Water Protection and Sustainability Program Trust Fund and |
84 | redistributed pursuant to the provisions of this section. |
85 | Section 4. The amendment of s. 403.890, Florida Statutes, |
86 | by this act shall expire July 1, 2012, and the text of that |
87 | section shall revert to that in existence on June 30, 2007, |
88 | except that any amendments to such text enacted other than by |
89 | this act shall be preserved and continue to operate to the |
90 | extent that such amendments are not dependent upon the portions |
91 | of such text which expire pursuant to this section. |
