5 | (9) Notwithstanding any other provision of law, counsel |
6 | appointed by the public defender to represent any individual in |
7 | a criminal or civil proceeding who is entitled to representation |
8 | pursuant to the Constitution of the United States or the State |
9 | Constitution or as authorized by general law, shall constitute |
10 | court-appointed counsel for purposes of s. 14, Art. V of the |
11 | State Constitution and the provision of such counsel shall be |
12 | funded through annual appropriations as provided by general law. |
13 | (10) Notwithstanding any other provision of law to the |
14 | contrary, no county shall be required, or be otherwise |
15 | obligated, to provide any funding for court-appointed counsel or |
16 | for counsel appointed by the public defender as described in |
17 | subsection (9), including the cost of communications services, |
18 | existing radio systems, existing multiagency criminal justice |
19 | information systems, and the cost of the construction or lease, |
20 | maintenance, utilities, and security of facilities as described |
21 | in s. 29.008. |
22 | (11)(10) This section does not apply to attorneys |
23 | appointed to represent persons in postconviction capital |
24 | collateral cases pursuant to part IV of this chapter. |
