1 A bill to be entitled
2 An act relating to a review under the Open
3 Government Sunset Review Act; amending s.
4 717.117, F.S.; revising the public-records
5 exemption for information held by the
6 Department of Financial Services which concerns
7 insurance and financial accounts; saving the
8 exemption from repeal under the Open Government
9 Sunset Review Act; deleting provisions that
10 provide for the repeal of the exemption;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (8) of section 717.117, Florida
16 Statutes, is amended to read:
17 717.117 Report of unclaimed property.--
18 (8) Social security numbers and insurance policy
19 account numbers, investment account numbers, pension and
20 profit-sharing account numbers, patient account numbers,
21 utility account numbers, customer account numbers, and wage,
22 payroll, and salary account numbers financial account numbers
23 contained in reports required under this section, held by the
24 department, are confidential and exempt from s. 119.07(1) and
25 s. 24(a), Art. I of the State Constitution. Notwithstanding
26 this exemption, social security numbers shall be released, for
27 the limited purpose of locating owners of abandoned or
28 unclaimed property, to an attorney, Florida-certified public
29 accountant, private investigator who is duly licensed in this
30 state, or a private investigative agency licensed under
31 chapter 493 and registered with the department under this

1 chapter. This exemption applies to social security numbers
2 and insurance policy account numbers, investment account
3 numbers, pension and profit-sharing account numbers, patient
4 account numbers, utility account numbers, customer account
5 numbers, and wage, payroll, and salary account numbers
6 financial account numbers held by the department before, on,
7 or after the effective date of this exemption. This subsection
8 is subject to the Open Government Sunset Review Act of 1995 in
9 accordance with s. 119.15, and shall stand repealed October 2,
10 2007, unless reviewed and saved from repeal through
11 reenactment by the Legislature.
12 Section 2. This act shall take effect October 1, 2007.

15 SENATE SUMMARY
16 Revises a public-records exemption for information held
by the Department of Financial Services which concerns
17 insurance and financial accounts. Removes the repeal of
the exemption which is scheduled to occur on October 2,
18 2007, under the Open Government Sunset Review Act.
