12 | provision relating to distributions from such trust fund |
13 | for a specified program; providing an effective date. |

15 | Be It Enacted by the Legislature of the State of Florida: |
16 |
|
17 | Section 1. Paragraph (d) of subsection (1) of section |
18 | 201.15, Florida Statutes, is amended to read: |
19 | 201.15 Distribution of taxes collected.--All taxes |
20 | collected under this chapter shall be distributed as follows and |
21 | shall be subject to the service charge imposed in s. 215.20(1), |
22 | except that such service charge shall not be levied against any |
23 | portion of taxes pledged to debt service on bonds to the extent |
24 | that the amount of the service charge is required to pay any |
25 | amounts relating to the bonds: |
26 | (1) Sixty-two and sixty-three hundredths percent of the |
27 | remaining taxes collected under this chapter shall be used for |
28 | the following purposes: |
29 | (d) The remainder of the moneys distributed under this |
30 | subsection, after the required payments under paragraphs (a), |
31 | (b), and (c), shall be paid into the State Treasury to the |
32 | credit of: |
33 | 1. The State Transportation Trust Fund in the Department |
34 | of Transportation in the amount of $541.75 million in each |
35 | fiscal year, to be paid in quarterly installments and used for |
36 | the following specified purposes, notwithstanding any other law |
37 | to the contrary: |
38 | a. For the purposes of capital funding for the New Starts |
39 | Transit Program, authorized by Title 49, U.S.C. s. 5309 and |
40 | specified in s. 341.051, 10 percent of these funds; |
41 | b. For the purposes of the Small County Outreach Program |
42 | specified in s. 339.2818, 5 percent of these funds; |
43 | c. For the purposes of the Strategic Intermodal System |
44 | specified in ss. 339.61, 339.62, 339.63, and 339.64, 75 percent |
45 | of these funds after allocating for the New Starts Transit |
46 | Program described in sub-subparagraph a. and the Small County |
47 | Outreach Program described in sub-subparagraph b.; and |
48 | d. For the purposes of the Transportation Regional |
49 | Incentive Program specified in s. 339.2819, 25 percent of these |
50 | funds after allocating for the New Starts Transit Program |
51 | described in sub-subparagraph a. and the Small County Outreach |
52 | Program described in sub-subparagraph b. |
53 | 2. The Water Protection and Sustainability Program Trust |
54 | Fund in the Department of Environmental Protection in the amount |
55 | of $100 million in each fiscal year, to be paid in quarterly |
56 | installments and used as required by s. 403.890. |
57 | 3. The Public Education Capital Outlay and Debt Service |
58 | Trust Fund in the Department of Education in the amount of $105 |
59 | million in each fiscal year, to be paid in monthly installments |
60 | with $75 million used to fund the Classrooms for Kids Program |
61 | created in s. 1013.735, and $30 million to be used to fund the |
62 | High Growth County District Capital Outlay Assistance Grant |
63 | Program created in s. 1013.738. If required, new facilities |
64 | constructed under the Classrooms for Kids Program must meet the |
65 | requirements of s. 1013.372. |
66 | 3.4. The Grants and Donations Trust Fund in the Department |
67 | of Community Affairs in the amount of $3.25 million in each |
68 | fiscal year to be paid in monthly installments, with $3 million |
69 | to be used to fund technical assistance to local governments and |
70 | school boards on the requirements and implementation of this act |
71 | and $250,000 to be used to fund the Century Commission |
72 | established in s. 163.3247. |

74 | Moneys distributed pursuant to this paragraph may not be pledged |
75 | for debt service unless such pledge is approved by referendum of |
76 | the voters. |
77 | Section 2. Subsection (7) of section 1013.64, Florida |
78 | Statutes, is amended to read: |
79 | 1013.64 Funds for comprehensive educational plant needs; |
80 | construction cost maximums for school district capital |
81 | projects.--Allocations from the Public Education Capital Outlay |
82 | and Debt Service Trust Fund to the various boards for capital |
83 | outlay projects shall be determined as follows: |
84 | (7) Moneys distributed to the Public Education Capital |
85 | Outlay and Debt Service Trust Fund pursuant to s. 201.15(1)(d) |
86 | to fund the Classrooms for Kids Program created in s. 1013.735 |
87 | and the High Growth County District Capital Outlay Assistance |
88 | Grant Program created in s. 1013.738 shall be distributed as |
89 | provided by those sections. |
90 | Section 3. Paragraph (a) of subsection (2) of section |
91 | 1013.65, Florida Statutes, is amended to read: |
92 | 1013.65 Educational and ancillary plant construction |
93 | funds; Public Education Capital Outlay and Debt Service Trust |
94 | Fund; allocation of funds.-- |
95 | (2)(a) The Public Education Capital Outlay and Debt |
96 | Service Trust Fund shall be comprised of the following sources, |
97 | which are hereby appropriated to the trust fund: |
98 | 1. Proceeds, premiums, and accrued interest from the sale |
99 | of public education bonds and that portion of the revenues |
100 | accruing from the gross receipts tax as provided by s. 9(a)(2), |
101 | Art. XII of the State Constitution, as amended, interest on |
102 | investments, and federal interest subsidies. |
103 | 2. General revenue funds appropriated to the fund for |
104 | educational capital outlay purposes. |
105 | 3. All capital outlay funds previously appropriated and |
106 | certified forward pursuant to s. 216.301. |
107 | 4.a. Funds paid pursuant to s. 201.15(1)(d). |
108 | b. The sum of $41.75 million of such funds shall be |
109 | appropriated annually for expenditure to fund the Classrooms for |
110 | Kids Program created in s. 1013.735 and shall be distributed as |
111 | provided by that section. |
112 | Section 4. Subsection (4) of section 1013.738, Florida |
113 | Statutes, is amended to read: |
114 | 1013.738 High Growth District Capital Outlay Assistance |
115 | Grant Program.-- |
116 | (4) Moneys distributed to the Public Education Capital |
117 | Outlay and Debt Service Trust Fund pursuant to s. 201.15(1)(d) |
118 | for the High Growth District Capital Outlay Assistance Grant |
119 | Program created in this section shall be distributed as provided |
120 | by this section. |
121 | Section 5. This act shall take effect July 1, 2007. |
