A bill to be entitled
2An act relating to public records; amending s. 119.071,
3F.S.; creating an exemption from public records
4requirements for specified United States Census Bureau
5address information held by an agency; providing an
6exception to the exemption; authorizing access to other
7related confidential or exempt information; providing for
8future review and repeal of the exemption; providing a
9statement of public necessity; providing an effective
10date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (g) is added to subsection (1) of
15section 119.071, Florida Statutes, to read:
16     119.071  General exemptions from inspection or copying of
17public records.--
18     (1)  AGENCY ADMINISTRATION.--
19     (g)1.  United States Census Bureau address information,
20which includes maps showing structure location points, agency
21records verifying addresses, and agency records identifying
22address errors or omissions, held by an agency pursuant to the
23Local Update of Census Addresses Program, Title 13, United
24States Code, Pub. L. No. 103-430, is confidential and exempt
25from s. 119.07(1) and s. 24(a), Art. I of the State
26Constitution.
27     2.  Such information may be released to another agency or
28governmental entity in the furtherance of its duties and
29responsibilities under the Local Update of Census Addresses
30Program.
31     3.  An agency performing duties and responsibilities under
32the Local Update of Census Addresses Program shall have access
33to any other confidential or exempt information held by another
34agency if such access is necessary in order to perform its
35duties and responsibilities under the program.
36     4.  This exemption is subject to the Open Government Sunset
37Review Act in accordance with s. 119.15 and shall stand repealed
38October 2, 2012, unless reviewed and saved from repeal through
39reenactment by the Legislature.
40     Section 2.  The Legislature finds that it is a public
41necessity that United States Census Bureau address information,
42which includes maps showing structure location points, agency
43records verifying addresses, and agency records identifying
44address errors or omissions, held by an agency be made
45confidential and exempt from public records requirements.
46Pursuant to the Local Update Census Addresses Program, Title 13,
47United States Code, Pub. L. No. 103-430, United States Census
48Bureau address information must be kept confidential. Further,
49all individuals directly involved in reviewing such information
50and any individuals with access to such information are required
51to sign a confidentiality agreement to preserve the
52confidentiality of the address information. Without this
53exemption, agencies would be prevented from participating in the
54program. As such, the effective and efficient administration of
55the Local Update of Census Addresses Program would be hindered
56at the federal level. Further, it could result in a negative
57fiscal impact on the state.
58     Section 3.  This act shall take effect upon becoming a law.
