12 | Be It Enacted by the Legislature of the State of Florida: |
13 |

14 | Section 1. Paragraph (g) is added to subsection (1) of |
15 | section 119.071, Florida Statutes, to read: |
16 | 119.071 General exemptions from inspection or copying of |
17 | public records.-- |
18 | (1) AGENCY ADMINISTRATION.-- |
19 | (g)1. United States Census Bureau address information, |
20 | which includes maps showing structure location points, agency |
21 | records verifying addresses, and agency records identifying |
22 | address errors or omissions, held by an agency pursuant to the |
23 | Local Update of Census Addresses Program, Title 13, United |
24 | States Code, Pub. L. No. 103-430, is confidential and exempt |
25 | from s. 119.07(1) and s. 24(a), Art. I of the State |
26 | Constitution. |
27 | 2. Such information may be released to another agency or |
28 | governmental entity in the furtherance of its duties and |
29 | responsibilities under the Local Update of Census Addresses |
30 | Program. |
31 | 3. An agency performing duties and responsibilities under |
32 | the Local Update of Census Addresses Program shall have access |
33 | to any other confidential or exempt information held by another |
34 | agency if such access is necessary in order to perform its |
35 | duties and responsibilities under the program. |
36 | 4. This exemption is subject to the Open Government Sunset |
37 | Review Act in accordance with s. 119.15 and shall stand repealed |
38 | October 2, 2012, unless reviewed and saved from repeal through |
39 | reenactment by the Legislature. |
40 | Section 2. The Legislature finds that it is a public |
41 | necessity that United States Census Bureau address information, |
42 | which includes maps showing structure location points, agency |
43 | records verifying addresses, and agency records identifying |
44 | address errors or omissions, held by an agency be made |
45 | confidential and exempt from public records requirements. |
46 | Pursuant to the Local Update Census Addresses Program, Title 13, |
47 | United States Code, Pub. L. No. 103-430, United States Census |
48 | Bureau address information must be kept confidential. Further, |
49 | all individuals directly involved in reviewing such information |
50 | and any individuals with access to such information are required |
51 | to sign a confidentiality agreement to preserve the |
52 | confidentiality of the address information. Without this |
53 | exemption, agencies would be prevented from participating in the |
54 | program. As such, the effective and efficient administration of |
55 | the Local Update of Census Addresses Program would be hindered |
56 | at the federal level. Further, it could result in a negative |
57 | fiscal impact on the state. |
58 | Section 3. This act shall take effect upon becoming a law. |
