11 The Committee on Criminal Justice (Argenziano) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 3, line 20, through
16 page 4, line 2, delete those lines
17
18 and insert: otherwise encumbered, the sum of $650,000 for
19 injuries and damages sustained due to the negligence of the
20 deputy sheriff of the Palm Beach County Sheriff's Office in
21 the following manner:
22 (1) Three hundred fifty thousand dollars, paid within
23 20 days after notice to the Palm Beach County Sheriff's Office
24 upon the effective date of this act; and
25 (2) Three hundred thousand dollars, paid 1 year
26 following the date of the payment of the first payment of
27 $350,000.

5 WHEREAS, Ms. Graham continues to suffer from chronic
6 pain, gait disfunction, and depression, and
7 WHEREAS, as a result of the accident, Ms. Graham
8 sustained a 40-percent permanent functional impairment and
9 permanent gait disfunction, and
10 WHEREAS, due to the severity of her injuries, Ms.
11 Graham has been unemployed and will require future medical
12 care over her lifetime, and
13 WHEREAS, Ms. Graham filed a lawsuit against the Palm
14 Beach County Sheriff's Office, and a trial was set to begin on
15 July 18, 2005, and
16 WHEREAS, on July 13, 2005, Ms. Graham and the Palm
17 Beach County Sheriff's Office entered into an agreement to
18 settle the lawsuit in the amount of $950,000, of which the
19 sheriff's office paid $100,000 at the time the settlement
20 agreement was signed by all parties, and
21 WHEREAS, the Senate Special Master recommended that the
22 claim be reduced by $200,000 to account for unsupported future
23 economic losses, NOW, THEREFORE,
