26         WHEREAS, on February 11, 2005, Brooke Ingoldsby, an
27  8-year-old third grader at James B. Sanderlin Elementary
28  School, was being transported home on a school bus of the
29  Pinellas County School Board which was driven by a substitute
30  bus driver employed by the school board, and
31         WHEREAS, rather than depositing Brooke, who was the

Florida Senate - 2007 SPECIAL MASTER AMENDMENT Bill No. SB 74 Barcode 165766 1 last student on the bus, at her appointed bus stop where her 2 grandmother was waiting for her, the substitute bus driver 3 dropped Brooke off on the corner of 90th Avenue and the east 4 side of 9th Street North, a busy thoroughfare in St. 5 Petersburg, Pinellas County, Florida, and 6 WHEREAS, Brooke was subsequently struck by a southbound 7 sports utility vehicle in the west-most southbound lane of 9th 8 Street North and was pronounced dead 3 hours later at Bayfront 9 Medical Center, and 10 WHEREAS, Brooke suffered multisystem trauma, head 11 injury, bilateral closed femur injury, a closed right humerus 12 fracture, and a severe abrasion to her right waistline, and 13 WHEREAS, the Pinellas County School Board admitted 14 liability for Brooke's death and agreed to pay the total sum 15 of $2.5 million for the damages and losses sustained by the 16 estate of Brooke Ingoldsby and for the losses suffered by 17 Brooke's mother, Michelle Allen, and 18 WHEREAS, judgment was entered in the amount of $2.5 19 million, including $200,000 in damages and losses sustained by 20 the estate of Brooke Ingoldsby and $2.3 million for the losses 21 suffered by Brooke's mother, Michelle Allen, and 22 WHEREAS, the school district has paid $100,000 to the 23 estate and $100,000 for the losses suffered by Michelle Allen, 24 thus exhausting the limits of the waiver of sovereign 25 immunity, and 26 WHEREAS, the school district maintained a liability 27 policy of $1 million, which was paid to Michelle Allen, and 28 WHEREAS, Michelle Allen has received $140,262 from 29 insurance policies and other collateral sources, NOW, 30 THEREFORE, 31 2 4:16 PM 03/23/07 s0074.sm.00a
