6 | Be It Enacted by the Legislature of the State of Florida: |

8 | Section 1. Paragraph (a) of subsection (5) of section |
9 | 1002.415, Florida Statutes, is amended to read: |
10 | 1002.415 K-8 Virtual School Program.--Subject to annual |
11 | legislative appropriation, a kindergarten through grade 8 |
12 | virtual school program is established within the Department of |
13 | Education for the purpose of making academic instruction |
14 | available to full-time students in kindergarten through grade 8 |
15 | using on-line and distance learning technology. The department |
16 | shall use an application process to select schools to deliver |
17 | program instruction. |
18 | (5) STUDENT ELIGIBILITY.-- |
19 | (a) Enrollment in each participating school is open to any |
20 | K-8 student in this state if the student meets at least one of |
21 | the following conditions: |
22 | 1. Complied during the prior school year with the regular |
23 | school attendance requirements of chapter 1003 Spent the prior |
24 | school year in attendance at a public school in this state and |
25 | was enrolled and reported by a public school district for |
26 | funding during the preceding October and February for purposes |
27 | of the Florida Education Finance Program surveys; |
28 | 2. Was enrolled during the prior school year in a K-8 |
29 | virtual school funded pursuant to this section or from funds |
30 | provided in the 2005 General Appropriations Act; |
31 | 3. Is eligible to enroll in kindergarten or the first |
32 | grade; or |
33 | 4. Has a sibling who is currently enrolled in a |
34 | participating K-8 virtual school and was enrolled at the end of |
35 | the prior school year. |
36 | Section 2. This act shall take effect July 1, 2007. |
