A bill to be entitled
2An act relating to the K-8 Virtual School Program;
3amending s. 1002.415, F.S.; expanding student eligibility
4for the program; providing an effective date.

6Be It Enacted by the Legislature of the State of Florida:

8     Section 1.  Paragraph (a) of subsection (5) of section
91002.415, Florida Statutes, is amended to read:
10     1002.415  K-8 Virtual School Program.--Subject to annual
11legislative appropriation, a kindergarten through grade 8
12virtual school program is established within the Department of
13Education for the purpose of making academic instruction
14available to full-time students in kindergarten through grade 8
15using on-line and distance learning technology. The department
16shall use an application process to select schools to deliver
17program instruction.
18     (5)  STUDENT ELIGIBILITY.--
19     (a)  Enrollment in each participating school is open to any
20K-8 student in this state if the student meets at least one of
21the following conditions:
22     1.  Complied during the prior school year with the regular
23school attendance requirements of chapter 1003 Spent the prior
24school year in attendance at a public school in this state and
25was enrolled and reported by a public school district for
26funding during the preceding October and February for purposes
27of the Florida Education Finance Program surveys;
28     2.  Was enrolled during the prior school year in a K-8
29virtual school funded pursuant to this section or from funds
30provided in the 2005 General Appropriations Act;
31     3.  Is eligible to enroll in kindergarten or the first
32grade; or
33     4.  Has a sibling who is currently enrolled in a
34participating K-8 virtual school and was enrolled at the end of
35the prior school year.
36     Section 2.  This act shall take effect July 1, 2007.
