11  The Committee on Community Affairs (Garcia) recommended the
12  following amendment:

14         Senate Amendment 
15         On page 6, line 13 through page 7,line 1, delete those
16  lines
17  
18  and insert:  (e)  At the discretion of the local government
19  and notwithstanding the requirements of this subsection, a
20  comprehensive plan, as revised by an amendment to its future
21  land use map, shall be deemed to be financially feasible and
22  to have achieved and maintained level-of-service standards
23  with respect to transportation facilities as required by this
24  section if the amendment to the future land use map is
25  supported by a:
26         1.  Condition in a development order for a
27  development-of-regional impact or binding agreement that
28  addresses proportionate share mitigation consistent with s.
29  163.3180(12);
30         or
31         2.  Binding agreement addressing proportionate

 1  fair-share mitigation consistent with s. 163.3180(16)(f) and
 2  the amendment to the future land use map is located within an
 3  area designated in a comprehensive plan for urban infill,
 4  urban redevelopment, downtown revitalization, urban infill and
 5  redevelopment, or an urban service area. The binding agreement
 6  must be based on the maximum amount of development identified
 7  by the future land use map amendment.
