| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 784.041, Florida Statutes, is amended |
| 12 | to read: |
| 13 | 784.041 Felony battery; domestic battery by |
| 14 | strangulation.-- |
| 15 | (1) A person who commits felony battery if he or she: |
| 16 | (a) Actually and intentionally touches or strikes another |
| 17 | person against the will of the other; and |
| 18 | (b) Causes great bodily harm, permanent disability, or |
| 19 | permanent disfigurement,. |
| 20 |
|
| 21 | (2) A person who commits felony battery, commits a felony of |
| 22 | the third degree, punishable as provided in s. 775.082, s. |
| 23 | 775.083, or s. 775.084. |
| 24 | (2)(a) For purposes of this subsection, the term: |
| 25 | 1. "Family or household member" has the meaning provided |
| 26 | in s. 741.28. |
| 27 | 2. "Persons in a dating relationship" has the same meaning |
| 28 | as used in s. 784.046(1)(d). |
| 29 | (b) A person who actually and intentionally, against the |
| 30 | will of the other: |
| 31 | 1. Impedes the normal breathing or circulation of the |
| 32 | blood of a family or household member or of a person with whom |
| 33 | he or she is in a dating relationship so as to create a risk of |
| 34 | great bodily harm; or |
| 35 | 2. Causes great bodily harm by: |
| 36 | a. Applying pressure on the throat or neck of the other |
| 37 | person; or |
| 38 | b. Blocking the nose or mouth of the other person, |
| 39 |
|
| 40 | commits domestic battery by strangulation, a felony of the third |
| 41 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 42 | 775.084. |
| 43 | Section 2. Paragraph (f) of subsection (3) of section |
| 44 | 921.0022, Florida Statutes, is amended to read: |
