| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 20.131, Florida Statutes, is created to |
| 12 | read: |
| 13 | 20.131 Department of Insurance.--There is created a |
| 14 | Department of Insurance. |
| 15 | (1) The head of the Department of Insurance is the |
| 16 | Insurance Commissioner. |
| 17 | (2) The following divisions of the Department of Insurance |
| 18 | are established: |
| 19 | (a) Division of Insurance Regulation. |
| 20 | (b) Division of Insurance Consumer Services. |
| 21 | (c) Division of Agents and Agencies Services. |
| 22 | (d) Division of Risk Management. |
| 23 | (e) Division of State Fire Marshal. |
| 24 | (f) Division of Insurance Fraud. |
| 25 | (g) Division of Funeral and Cemetery Services. |
| 26 | (h) Division of Workers' Compensation. |
| 27 | (3)(a) The department shall have an assistant insurance |
| 28 | commissioner and shall have three deputy assistant |
| 29 | commissioners, one of whom shall serve as general counsel. |
| 30 | (b) All divisions shall have a director. The department |
| 31 | may change the name of any division, by rule, if the name |
| 32 | reflects the respective subject area of the division. |
| 33 | Section 2. This act shall take effect January 6, 2009, if |
| 34 | HJR 829 or a similar joint resolution creating the office of |
| 35 | Insurance Commissioner is adopted at the 2007 Regular Session of |
| 36 | the Legislature or an extension thereof and is approved by the |
| 37 | electors at the general election to be held in November 2008. |
