15 On page 6, between lines 16 and 17,

17 insert:
18 Section 5. Section 627.7261, Florida Statutes, is
19 amended to read:
20 627.7261 Refusal to issue policy.--
21 (1) An No insurer may not deny an application for
22 automobile liability insurance solely on the ground that
23 renewal of similar coverage has been denied by another insurer
24 or on the ground of an applicant's failure to disclose that
25 such denial has occurred.
26 (2)(a) An insurer may not deny an application for
27 automobile liability insurance or impose a surcharge or
28 otherwise increase the premium rate for an automobile
29 liability policy solely on the basis that the applicant, a
30 named insured, a member of the insured's household, or a
31 person who customarily operates the insured's vehicle is a

1 volunteer driver.
2 (b) As used in this section, the term "volunteer
3 driver" means a person who provides services, including
4 transporting individuals or goods, without compensation in
5 excess of expenses to a private nonprofit agency as defined in
6 s. 273.01(3) or a charitable organization as defined in s.
7 737.501(2).
8 (c) This section does not prohibit an insurer from
9 refusing to renew, imposing a surcharge on, or otherwise
10 increasing the premium rate for an automobile liability
11 insurance policy based upon factors other than the volunteer
12 status of the persons named in this subsection.

19 On page 1, line 14, after the semicolon,

21 insert:
22 amending s. 627.7261, F.S.; prohibiting an
23 insurer from taking certain actions solely
24 because an insured or specified person serves
25 as a volunteer driver for a nonprofit agency or
26 charitable organization;
