1 A bill to be entitled
2 An act relating to personal injury protection
3 insurance; amending s. 627.733, F.S.; expanding
4 an exemption to the requirement to maintain
5 personal injury protection security on a motor
6 vehicle for members of the United States Armed
7 Forces on active duty to include the dependent
8 spouses of such servicemembers; providing
9 conditions for eligibility; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (5) of section 627.733, Florida
15 Statutes, is amended to read:
16 627.733 Required security.--
17 (5) In addition to other persons who are not required
18 to provide required security as required under this section
19 and s. 324.022, the owner or registrant of a motor vehicle is
20 exempt from such requirements if she or he is a member of the
21 United States Armed Forces and is called to or on active duty
22 outside the state or the United States or if she or he is the
23 dependent spouse of an active duty servicemember who resides
24 with the active duty servicemember and the vehicle is
25 maintained at the location at which they reside in an
26 emergency situation. The exemption provided by this subsection
27 applies only as long as the member of the armed forces is on
28 such active duty outside the state or the United States and
29 applies only while the vehicle covered by the security
30 required by this section and s. 324.022 is not operated by any
31 person. Upon receipt of a written request by the insured to

1 whom the exemption provided in this subsection applies, the
2 insurer shall cancel the coverages and return any unearned
3 premium or suspend the security required by this section and
4 s. 324.022. Notwithstanding subsection (6), the Department of
5 Highway Safety and Motor Vehicles may not suspend the
6 registration or operator's license of any owner or registrant
7 of a motor vehicle during the time she or he qualifies for an
8 exemption under this subsection. Any owner or registrant of a
9 motor vehicle who qualifies for an exemption under this
10 subsection shall immediately notify the department prior to
11 and at the end of the expiration of the exemption.
12 Section 2. This act shall take effect July 1, 2007.
