2 An act relating to a review under the Open
3 Government Sunset Review Act; amending s.
4 119.071, F.S., relating to a public-records
5 exemption for building plans and other drawings
6 of a building owned or operated by an agency;
7 making editorial changes; saving the exemption
8 from repeal under the Open Government Review
9 Act; deleting the provision that provides for
10 the repeal of the exemption; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (b) of subsection (3) of section
16 119.071, Florida Statutes, is amended to read:
17 119.071 General exemptions from inspection or copying
18 of public records.--
19 (3) SECURITY.--
20 (b)1. Building plans, blueprints, schematic drawings,
21 and diagrams, including draft, preliminary, and final formats,
22 which depict the internal layout and structural elements of a
23 building, arena, stadium, water treatment facility, or other
24 structure owned or operated by an agency are exempt from s.
25 119.07(1) and s. 24(a), Art. I of the State Constitution.
26 2. This exemption applies to building plans,
27 blueprints, schematic drawings, and diagrams, including draft,
28 preliminary, and final formats, which depict the internal
29 layout and structural elements of a building, arena, stadium,
30 water treatment facility, or other structure owned or operated

1 by an agency before, on, or after the effective date of this
2 act.
3 3. Information made exempt by this paragraph may be
4 disclosed:
5 a. To another governmental entity if disclosure is
6 necessary for the receiving entity to perform its duties and
7 responsibilities;
8 b. To a licensed architect, engineer, or contractor
9 who is performing work on or related to the building, arena,
10 stadium, water treatment facility, or other structure owned or
11 operated by an agency; or
12 c. Upon a showing of good cause before a court of
13 competent jurisdiction.
14 4. The entities or persons receiving such information
15 shall maintain the exempt status of the information. This
16 paragraph is subject to the Open Government Sunset Review Act
17 in accordance with s. 119.15 and shall stand repealed on
18 October 2, 2007, unless reviewed and reenacted by the
19 Legislature.
20 Section 2. This act shall take effect October 1, 2007.
