1 A bill to be entitled
2 An act relating to HIV/AIDS; requiring the
3 Department of Health, in conjunction with the
4 Department of Corrections and the Department of
5 Juvenile Justice, to develop a plan to address
6 HIV prevention, testing, and treatment of
7 certain persons in the custody of the
8 Department of Corrections or the Department of
9 Juvenile Justice; providing requirements for
10 the plan; requiring a report to the Governor
11 and Legislature; requiring the Office of
12 Program Policy Analysis and Government
13 Accountability to complete a study and propose
14 recommendations concerning the distribution of
15 federal HIV/AIDS funding and barriers to
16 obtaining drugs and other medical services for
17 HIV-infected individuals and persons living
18 with AIDS in areas having the highest rates of
19 HIV infection in the state; providing
20 requirements for the report; providing an
21 effective date.

23 Be It Enacted by the Legislature of the State of Florida:

25 Section 1. The Department of Health, in conjunction
26 with the Department of Corrections and the Department of
27 Juvenile Justice, shall develop a plan to address HIV
28 prevention and the testing and treatment of juveniles in the
29 custody of the Department of Juvenile Justice and persons
30 incarcerated by the Department of Corrections. The plan must
31 identify any barriers to the prevention of HIV infection among

1 inmates held by the Department of Corrections and juveniles
2 held by the Department of Juvenile Justice and any
3 constitutional or legal issues relating to HIV prevention
4 programs, testing, and treatment provided in prisons or in
5 commitment programs of the Department of Juvenile Justice. The
6 Department of Health shall complete the plan and submit its
7 findings and recommendations to the Governor, the President of
8 the Senate, and the Speaker of the House of Representatives by
9 January 1, 2008.
10 Section 2. The Office of Program Policy Analysis and
11 Government Accountability shall complete a study on the
12 distribution of funding authorized under the federal Ryan
13 White Comprehensive AIDS Resources Emergency Act and
14 subsequent reauthorizations in Florida in order to determine
15 whether the distribution of this funding is addressing the
16 needs of areas within the state having the highest rates of
17 HIV infection or the highest number of people living with
18 AIDS. The office shall also identify any significant barriers
19 of access to drugs and other vital medical services for AIDS
20 treatment by persons living in areas within the state having
21 the highest rates of HIV infection. The office shall complete
22 the study and report its findings and recommendations to the
23 President of the Senate and the Speaker of the House of
24 Representatives by January 1, 2008.
25 Section 3. This act shall take effect July 1, 2007.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

4 The committee substitute directs the Department of Health, in
conjunction with the Department of Corrections and the
5 Department of Juvenile Justice, to develop a plan to address
HIV prevention and the testing and treatment of juveniles in
6 Department of Juvenile Justice commitment programs and inmates
held by the Department of Corrections. The plan must address
7 any constitutional or legal issues relating to HIV prevention
programs, testing, and treatment provided in prisons or
8 Department of Juvenile Justice commitment programs.
9 The Office of Program Policy Analysis and Government
Accountability (OPPAGA) must complete a study on the
10 distribution of federal Ryan White funds in Florida to
determine whether the distribution of this funding is meeting
11 the needs of areas in Florida that have the highest rates of
HIV infection or the highest number of people living with
12 AIDS. OPPAGA must also identify any significant barriers to
access to drugs or other vital AIDS treatments by persons
13 living in areas in Florida with the highest rates of HIV
infection.

The findings and recommendations of both the plan and report
15 required by the bill must be submitted by January 1, 2008.
