A bill to be entitled
2An act relating to construction contractors; amending s.
3489.127, F.S.; specifying additional prohibited activities
4for certain contractors relating to unlicensed or
5unpermitted activity; providing a penalty; revising
6construction of a limitation on local jurisdictions
7exercising disciplinary authority; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (d) of subsection (4) of section
13489.127, Florida Statutes, is redesignated as paragraph (e), a
14new paragraph (d) is added to that subsection, and paragraph (o)
15of subsection (5) of that section is amended, to read:
16     489.127  Prohibitions; penalties.--
17     (4)
18     (d)  A certified or registered contractor, or contractor
19authorized by a local construction licensing board to do
20contracting, may not perform work for which he or she is not
21properly licensed, or subcontract to unlicensed persons to
22perform work that requires a license, or fail to obtain required
23permits.
24     (e)(d)1.  A person who violates this subsection commits a
25misdemeanor of the first degree, punishable as provided in s.
26775.082 or s. 775.083.
27     2.  A person who violates this subsection after having been
28previously found guilty of such violation commits a felony of
29the third degree, punishable as provided in s. 775.082 or s.
30775.083.
31     (5)  Each county or municipality may, at its option,
32designate one or more of its code enforcement officers, as
33defined in chapter 162, to enforce, as set out in this
34subsection, the provisions of subsection (1) and s. 489.132(1)
35against persons who engage in activity for which a county or
36municipal certificate of competency or license or state
37certification or registration is required.
38     (o)  Nothing in this subsection shall be construed to
39authorize local jurisdictions to exercise disciplinary
40authority, other than civil citations, which shall not be
41considered discipline, or procedures established in this
42subsection against an individual holding a proper valid
43certificate issued pursuant to this part.
44     Section 2.  This act shall take effect July 1, 2007.
