10 | Be It Enacted by the Legislature of the State of Florida: |
11 |
|
12 | Section 1. Paragraph (d) of subsection (4) of section |
13 | 489.127, Florida Statutes, is redesignated as paragraph (e), a |
14 | new paragraph (d) is added to that subsection, and paragraph (o) |
15 | of subsection (5) of that section is amended, to read: |
16 | 489.127 Prohibitions; penalties.-- |

18 | (d) A certified or registered contractor, or contractor |
19 | authorized by a local construction licensing board to do |
20 | contracting, may not perform work for which he or she is not |
21 | properly licensed, or subcontract to unlicensed persons to |
22 | perform work that requires a license, or fail to obtain required |
23 | permits. |
24 | (e)(d)1. A person who violates this subsection commits a |
25 | misdemeanor of the first degree, punishable as provided in s. |
26 | 775.082 or s. 775.083. |
27 | 2. A person who violates this subsection after having been |
28 | previously found guilty of such violation commits a felony of |
29 | the third degree, punishable as provided in s. 775.082 or s. |
30 | 775.083. |
31 | (5) Each county or municipality may, at its option, |
32 | designate one or more of its code enforcement officers, as |
33 | defined in chapter 162, to enforce, as set out in this |
34 | subsection, the provisions of subsection (1) and s. 489.132(1) |
35 | against persons who engage in activity for which a county or |
36 | municipal certificate of competency or license or state |
37 | certification or registration is required. |
38 | (o) Nothing in this subsection shall be construed to |
39 | authorize local jurisdictions to exercise disciplinary |
40 | authority, other than civil citations, which shall not be |
41 | considered discipline, or procedures established in this |
42 | subsection against an individual holding a proper valid |
43 | certificate issued pursuant to this part. |
44 | Section 2. This act shall take effect July 1, 2007. |
