| 15 | Be It Enacted by the Legislature of the State of Florida: |
| 16 |
|
| 17 | Section 1. Paragraph (a) of subsection (2), paragraph (b) |
| 18 | of subsection (7), and paragraph (b) of subsection (8) of |
| 19 | section 849.086, Florida Statutes, are amended to read: |
| 20 | 849.086 Cardrooms authorized.-- |
| 21 | (2) DEFINITIONS.--As used in this section: |
| 22 | (a) "Authorized game" means a game or series of games of |
| 23 | cards poker which are played in a nonbanking manner. |
| 24 | (7) CONDITIONS FOR OPERATING A CARDROOM.-- |
| 25 | (b) Any horserace, greyhound, or jai alai permitholder |
| 26 | licensed under this section may operate a cardroom at the pari- |
| 27 | mutuel facility on any day between the hours of 12 noon and 12 |
| 28 | midnight if the permitholder conducted a full schedule of live |
| 29 | racing or games in the preceding year. A cardroom may be |
| 30 | operated at the facility only when the facility is authorized to |
| 31 | accept wagers on pari-mutuel events during its authorized meet. |
| 32 | A cardroom may operate between the hours of 12 noon and 12 |
| 33 | midnight on any day a pari-mutuel event is conducted live as a |
| 34 | part of its authorized meet. However, a permitholder who holds a |
| 35 | valid cardroom license may operate a cardroom between the hours |
| 36 | of 12 noon and 12 midnight on any day that live racing of the |
| 37 | same class of permit is occurring within 35 miles of its |
| 38 | facility if no other holder of that same class of permit within |
| 39 | 35 miles is operating a cardroom at such time and if all holders |
| 40 | of the same class of permit within the 35-mile area have given |
| 41 | their permission in writing to the permitholder to operate the |
| 42 | cardroom during the designated period. Application to operate a |
| 43 | cardroom under this paragraph must be made to the division as |
| 44 | part of the annual license application. |
| 45 | (8) METHOD OF WAGERS; LIMITATION.-- |
| 46 | (b) The cardroom operator may limit the amount wagered in |
| 47 | any game or series of games, but the maximum bet may not exceed |
| 48 | $2 in value. There may not be more than three raises in any |
| 49 | round of betting. However, in any authorized game that involves |
| 50 | a single wager per hand rather than multiple rounds of betting, |
| 51 | the maximum amount that may be wagered on any hand is $40. The |
| 52 | fee charged by the cardroom for participation in the game shall |
| 53 | not be included in the calculation of the limitation on the bet |
| 54 | amount provided in this paragraph. |
| 55 | Section 2. This act shall take effect July 1, 2007. |
