17         Section 5.  Visual and performing arts education.--By
18  February 1, 2008, the Commissioner of Education shall submit a
19  report to the Governor, the President of the Senate, and the
20  Speaker of the House of Representatives detailing the
21  opportunities for students in this state to participate in
22  visual and performing arts education in K-12 public schools.
23  The report shall include:
24         (1)  Enrollment data for students enrolled in visual
25  and performing arts courses for the previous 5 school years,
26  reported separately for music, visual arts, theatre, and dance
27  by grade level; and
28         (2)  An analysis of the correlation between student
29  participation in visual and performing arts education and
30  overall student performance. The analysis shall examine the
31  number of credits in visual and performing arts taken by grade

Barcode 460164 1 12 students in public high school during the previous 5 school 2 years compared to their graduation rates, grade point 3 averages, and attendance data. 4 Section 6. The Office of Program Policy Analysis and 5 Government Accountability shall conduct a study of exceptional 6 student education for in-state students placed in private 7 residential care facilities. 8 (1) For purposes of this section, the term: 9 (a) "Agency" means an entity in the executive branch 10 of state government. 11 (b) "Exceptional student" means an exceptional student 12 with a disability as defined in s. 1003.01(3), Florida 13 Statutes, whose parent resides in Florida and who is referred 14 to or placed by an agency in a private residential care 15 facility. 16 (2) In conducting the study required by this section, 17 the Office of Program Policy Analysis and Government 18 Accountability shall: 19 (a) Review and summarize federal and state law and 20 administrative rules relating to the requirements for 21 educational services for exceptional students. 22 (b) Identify the practices implemented by agencies and 23 district school boards for the provision of educational 24 services to exceptional students. Such identification shall 25 include, but is not limited to: 26 1. Agency practices, prior to referral or placement, 27 for notifying and consulting with the district school board 28 that is currently serving the exceptional student and the 29 district school board of the school district in which the 30 private residential care facility is located. 31 2. Barcode 460164 1 allocating financial and other responsibilities associated 2 with the provision of educational services to an exceptional 3 student. 4 (3) A final report of the study shall be submitted to 5 the President of the Senate and the Speaker of the House of 6 Representatives by December 31, 2007. The final report shall 7 include an evaluation of the practices identified under 8 paragraph (2)(b) and recommendations for the improvement of 9 those practices.
