A bill to be entitled
2An act relating to public school physical education;
3amending s. 1003.455, F.S.; providing requirements for
4student participation in physical education; requiring
5review and revision of the Sunshine State Standards for
6physical education; amending s. 1012.98, F.S.; requiring
7the Department of Education to develop and school
8districts to provide a professional development program;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 1003.455, Florida Statutes, is amended
14to read:
15     1003.455  Physical education programs; assessment.--
16     (1)  It is the responsibility of each district school board
17to develop a physical education program that stresses physical
18fitness and encourages healthful, active lifestyles. Each
19district school board shall require all students in kindergarten
20through grade 5, and to encourage all students in grades 6
21through prekindergarten through grade 12, to participate in
22physical education. Physical education shall consist of physical
23activities of at least a moderate intensity level and for a
24duration sufficient to provide a significant health benefit to
25students, subject to the differing capabilities of students. All
26physical education programs and curricula must be reviewed by a
27certified physical education instructor.
28     (2)  Each district school board shall adopt a written
29physical education policy that details the school district's
30physical education program and expected program outcomes.
31     (3)  Each district school board shall require each
32kindergarten through grade 5 student to participate in physical
33education daily to consist of is encouraged to provide 150
34minutes of physical education each week for students in
35kindergarten through grade 5 and shall encourage each student in
36grades 6 through 12 to participate in physical education for 225
37minutes each week for students in grades 6 through 8.
38     (4)  The State Board of Education shall review and revise
39as necessary the Sunshine State Standards for physical education
40to ensure that the standards reflect state-of-the-art physical
41education philosophy and practice.
42     Section 2.  Paragraph (c) of subsection (4) of section
431012.98, Florida Statutes, is redesignated as paragraph (d) and
44a new paragraph (c) is added to that subsection to read:
45     1012.98  School Community Professional Development Act.--
46     (4)  The Department of Education, school districts,
47schools, community colleges, and state universities share the
48responsibilities described in this section. These
49responsibilities include the following:
50     (c)  The department shall develop and each school district
51shall provide a professional development program for physical
52education instructors, elementary and secondary school teachers
53whose responsibilities include teaching physical education
54classes, and developers of physical education curricula.
55     Section 3.  This act shall take effect July 1, 2007.
