| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Subsection (1) of section 627.672, Florida |
| 12 | Statutes, is amended to read: |
| 13 | 627.672 Definitions.--For the purposes of ss. 627.671- |
| 14 | 627.671-627.675: |
| 15 | (1) A "Medicare supplement policy" is a health insurance |
| 16 | policy or other health benefit plan offered by a private entity |
| 17 | to individuals who are entitled to have payments for health care |
| 18 | costs made under Medicare, Title XVIII of the Social Security |
| 19 | Act ("Medicare"), as presently constituted and as may later be |
| 20 | amended, which provides reimbursement for expenses incurred for |
| 21 | services and items for which payment may be made under Medicare |
| 22 | but which expenses are not reimbursable by reason of the |
| 23 | applicability of deductibles, coinsurance amounts, or other |
| 24 | limitations imposed by Medicare. The term does not include any |
| 25 | such policy or plan of one or more employers that have at least |
| 26 | 50 employees at issue or labor organizations, or of the trustees |
| 27 | of a fund established by one or more employers or labor |
| 28 | organizations, or a combination thereof, for employees or former |
| 29 | employees, or a combination thereof, or for members or former |
| 30 | members, or a combination thereof, of the labor organizations |
| 31 | if, upon termination of eligibility, group members age 65 or |
| 32 | older are offered continuation of coverage under the group plan |
| 33 | or a conversion policy with the same benefits as a Medicare |
| 34 | supplement policy. |
| 35 | Section 2. This act shall take effect July 1, 2007. |
