2An act relating to local oversight of contractors;
3amending s. 489.105, F.S.; providing a definition;
4amending s. 489.113, F.S.; providing powers and duties of
5local enforcement boards relating to certified
6contractors; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Subsection (20) is added to section 489.105,
11Florida Statutes, to read:
12     489.105  Definitions.--As used in this part:
13     (20)  "Local enforcement board" means a local board that
14exercises disciplinary control and oversight over locally
15licensed contractors under s. 489.131(10).
16     Section 2.  Paragraph (b) of subsection (4) of section
17489.113, Florida Statutes, is amended to read:
18     489.113  Qualifications for practice; restrictions.--
19     (4)
20     (b)  Notwithstanding the provisions of paragraph (a), a
21local construction regulation board or local enforcement board
22may deny, suspend, or revoke the authority of a certified
23contractor to obtain a building permit or limit such authority
24to obtaining a permit or permits with specific conditions, if
25the local construction regulation board or local enforcement
26board has found such contractor, through the public hearing
27process, to be guilty of fraud or a willful building code
28violation within the county or municipality that the local
29construction regulation board or local enforcement board
30represents or if the local construction regulation board or
31local enforcement board has proof that such contractor, through
32the public hearing process, has been found guilty in another
33county or municipality within the past 12 months, of fraud or a
34willful building code violation and finds, after providing
35notice of an opportunity to be heard to the contractor, that
36such fraud or violation would have been fraud or a violation if
37committed in the county or municipality that the local
38construction board or local enforcement board represents.
39Notification of and information concerning such permit denial
40shall be submitted to the department within 15 days after the
41local construction regulation board or local enforcement board
42decides to deny the permit.
43     Section 3.  This act shall take effect July 1, 2007.
