14         Senate Amendment (with title amendment) 
15         On page 63, between lines 26 and 27,
16  
17  insert:  
18         Section 40.  Subsection (1) of section 339.09, Florida
19  Statutes, is amended to read:
20         339.09  Use of transportation tax revenues;
21  restrictions.--
22         (1)  Funds available to the department shall not be
23  used for any nontransportation purpose. However, the
24  department shall construct and maintain roads, parking areas,
25  and other transportation facilities adjacent to and within the
26  grounds of state institutions, public community colleges,
27  farmers' markets, and wayside parks upon request of the proper
28  authorities. The department is encouraged and permitted to use
29  funds to construct and maintain noise mitigation facilities or
30  walls upon request of the proper authorities.
