3     Amendment (with directory and title amendments)
4     Between lines 3465 and 3466, insert:
5     Section 52.  Subsection (2) of section 348.0003, Florida
6Statutes, is amended to read:
7     348.0003  Expressway authority; formation; membership.--
8     (2)  The governing body of an authority shall consist of
9not fewer than five nor more than nine voting members. The
10district secretary of the affected department district shall
11serve as a nonvoting member of the governing body of each
12authority located within the district. Each member of the
13governing body must at all times during his or her term of
14office be a permanent resident of the county which he or she is
15appointed to represent.
16     (a)  Two members of the authority shall be appointed for
17terms of 4 years by the Governor, subject to confirmation by the
18Senate. Such persons may not hold elective office during their
19terms of office.
20     (b)  For a single-county authority, the remaining members
21shall be appointed by the board of county commissioners for
22terms of 3 years.
23     (c)  For a multicounty authority, the remaining members
24shall be apportioned, based on the population of such counties,
25among the counties within the authority. Each such member shall
26be appointed by the applicable board of county commissioners for
27a term of 3 years.
28     (d)  Notwithstanding any provision to the contrary in this
29subsection, in any county as defined in s. 125.011(1), the
30governing body shall be abolished on or before December 31,
312007. Prior to the termination of the existing governing body, a
32new governing body consisting of an authority shall consist of
33up to 13 7 members shall be appointed as follows:, and the
34following provisions of this paragraph shall apply specifically
35to such authority. Except for the district secretary of the
36department, the members must be residents of the county. Seven
37voting members shall be appointed by the governing body of the
38county. At the discretion of the governing body of the county,
39up to two of the members appointed by the governing body of the
40county may be elected officials residing in the county. Five
41voting members of the authority shall be appointed by the
42Governor. One member shall be the district secretary of the
43department serving in the district that contains such county.
44This member shall be an ex officio voting member of the
45authority. If the governing board of an authority includes any
46member originally appointed by the governing body of the county
47as a nonvoting member, when the term of such member expires,
48that member shall be replaced by a member appointed by the
49Governor until the governing body of the authority is composed
50of seven members appointed by the governing body of the county
51and five members appointed by the Governor.
52     1. Three voting members shall be appointed by the Board of
53County Commissioners encompassing the county served by the
54authority.
55     2. Three voting members shall be appointed by the Governor
56subject to confirmation by the Senate at the next regular
57session of the Legislature. Refusal or failure of the Senate to
58confirm an appointment shall create a vacancy.
59     3. One member shall be the district secretary of the
60Department of Transportation serving in the district that
61contains the county served by the authority, who shall serve ex
62officio.
63     4. Each such member's term of office shall be for 4 years
64or until his or her successor shall have been appointed and
65qualified. However, for the purpose of providing staggered
66terms, of the initial appointments by the Governor and the Board
67of County Commissioners shall be as follows:
68     a. For the members to be appointed by the Governor; one
69member shall serve shall serve for 1 year; one member shall
70serve for 2 years; and one member shall serve for 3 years.
71     b. For the members to be appointed by the the Board of
72County Commissioners; one member shall serve shall serve for 1
73year; one member shall serve for 2 years; and one member shall
74serve for 3 years.
75     (e)  The qualifications, terms of office, and obligations
76and rights of members of the authority shall be determined by
77resolution or ordinance of the governing body of the county in a
78manner that is consistent with subsections (3) and (4).
