  1                      A bill to be entitled

  2         An act relating to energy; specifying a limited

  3         period during which the sale of

  4         energy-efficient products for noncommercial or

  5         personal use is exempt from sales tax;

  6         providing a limitation; providing a definition;

  7         prohibiting the purchase of products by certain

  8         payment methods; providing that certain

  9         purchases or attempts to purchase are unfair

10         methods of competition and punishable as such;

11         authorizing the Department of Revenue to adopt

12         rules; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  The tax levied under chapter 212, Florida

17  Statutes, may not be collected during the 14-day period

18  beginning at 12:01 a.m., on the first Saturday in October

19  2007, on the sale of a new energy-efficient product having a

20  selling price of $1,500 or less per product during that

21  period. This exemption applies only when the energy-efficient

22  product is purchased for noncommercial home or personal use

23  and does not apply when the product is purchased for trade,

24  business, or resale. As used in this section, the term

25  "energy-efficient product" means a dishwasher, clothes washer,

26  air conditioner, ceiling fan, compact florescent light bulb,

27  dehumidifier, programmable thermostat, or refrigerator that

28  has been designated by the United States Environmental

29  Protection Agency or by the United States Department of Energy

30  as meeting or exceeding the requirements under the Energy Star

31  Program of either agency. Purchases made under this subsection

 1  may not be made using a business or company credit or debit

 2  card or check. Any construction company, building contractor,

 3  or commercial business or entity that purchases or attempts to

 4  purchase the energy-efficient products as exempt under this

 5  section commits the offense of engaging in an unfair method of

 6  competition in violation of s. 501.204, Florida Statutes,

 7  punishable as provided in s. 501.2075, Florida Statutes.

 8  Notwithstanding chapter 120, Florida Statutes, the Department

 9  of Revenue may adopt rules to administer this section.

10         Section 2.  This act shall take effect upon becoming a

11  law.

13          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
14          CS/CS Senate Bill 996 and CS Senate Bill 2666

15                                 

16  The Committee Substitute deletes everything from both bills
    except for a 14-day sales tax holiday on energy-efficient
17  products beginning in October, 2007, and combines the bills.
