A bill to be entitled
2An act relating to insurance; amending s. 626.9541, F.S.;
3providing that an insurer's failure to offer in this state
4any kind or line of insurance offered in another
5jurisdiction constitutes an unfair method of competition
6and an unfair or deceptive act; providing penalties;
7requiring the Financial Services Commission to adopt
8rules; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (ee) is added to subsection (1) of
13section 626.9541, Florida Statutes, to read:
14     626.9541  Unfair methods of competition and unfair or
15deceptive acts or practices defined.--
16     (1)  UNFAIR METHODS OF COMPETITION AND UNFAIR OR DECEPTIVE
17ACTS.--The following are defined as unfair methods of
18competition and unfair or deceptive acts or practices:
19     (ee)  Selectively limiting insurance offerings.--Failing to
20offer in this state a kind or line of insurance which the
21insurer offers in another jurisdiction. An insurer need not
22offer every kind or line of insurance, or any particular kind or
23line of insurance, in this state; however, if an insurer offers
24a particular kind or line of insurance anywhere the insurer does
25business, the insurer must offer the same kind or line in this
26state. The commission shall adopt rules to implement and
27administer this paragraph.
28     Section 2.  This act shall take effect upon becoming a law.
