11  The Committee on Banking and Insurance (Storms) recommended
12  the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 107, between lines 5 and 6,
16  
17  insert:  
18         Section 21.  Paragraph (ee) is added to subsection (1)
19  of section 626.9541, Florida Statutes, to read:
20         626.9541  Unfair methods of competition and unfair or
21  deceptive acts or practices defined.--
22         (1)  UNFAIR METHODS OF COMPETITION AND UNFAIR OR
23  DECEPTIVE ACTS.--The following are defined as unfair methods
24  of competition and unfair or deceptive acts or practices:
25         (ee)  Selectively limiting insurance
26  offerings.--Failing to offer in this state a kind or line of
27  insurance which all insurers or affiliated insurers, as
28  defined by the Financial Services Commission, offer in another
29  jurisdiction. An insurer need not offer every kind or line of
30  insurance, or any particular kind or line of insurance, in
31  this state; however, if, on July 1, 2007, an insurer offers a

 1  particular kind or line of insurance anywhere it does
 2  business, it must offer the same kind or line in this state.
 3  The commission shall adopt rules to administer this paragraph.

10         On page 6, line 4, after the semicolon,

12  insert:
13         amending s. 626.9541, F.S.; providing that an
14         insurer's failure to offer in this state any
15         kind or line of insurance which all insurers or
16         affiliated insurers offer in another
17         jurisdiction constitutes an unfair method of
18         competition and unfair or deceptive act;
19         providing penalties; providing for rules;
