18 and insert:
19 (b) A millage rate higher than the maximum millage
20 rate that may be levied under paragraph (a) may be adopted by
21 a two-thirds vote of the governing body of the municipality or
22 special district dependent thereto.
23 (4) The maximum millage rate that an independent
24 special district may levy by a majority vote of the governing
25 body for the 2007-2008 fiscal year is 97 percent of the
26 rolled-back rate, as calculated under s. 200.065. A millage
27 rate higher than the maximum millage rate specified in this
28 subsection may be adopted by a two-thirds vote of the
29 governing body of the independent special district.
30 (5) In the 2008-2009 fiscal year, a county, municipal
31 service taxing units of that county, and special districts

1 dependent to that county; a municipality and special districts
2 dependent to that municipality; and an independent special
3 district may levy a maximum millage determined as follows:
4 (a) The maximum millage rate that may be levied shall
5 be the rolled-back rate calculated pursuant to s. 200.065 and
6 adjusted for growth in per capita Florida personal income,
7 except that ad valorem tax revenue levied in the 2007-2008
8 fiscal year shall be reduced by any tax revenue resulting from
9 a millage rate approved by a super majority vote of the
10 governing board of the taxing authority in excess of the
11 maximum rate that could have been levied by a majority vote as
12 provided in this section.
13 (b) A rate in excess of the millage rate allowed in
14 paragraph (a) may be adopted by a two-thirds vote of the
15 governing body.
