A bill to be entitled
2An act relating to property taxes; amending s. 200.185,
3F.S.; changing the time a municipality must have been in a
4state of financial emergency to be considered a
5municipality of special financial concern; providing for
6calculating maximum millage rates for 2008-2009 fiscal
7year for certain municipalities; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (b) of subsection (1) of section
13200.185, Florida Statutes, is amended to read:
14     200.185  Maximum millage rates for the 2007-2008 and 2008-
152009 fiscal years.--
16     (1)  As used in this section, the term:
17     (b)  "Municipality of special financial concern" means a
18municipality within a county of special financial concern or a
19municipality that has been at any time since June 30, 2002, 2001
20in a state of financial emergency pursuant to s. 218.503.
21     Section 2.  For purposes of determining maximum millage
22rates for the 2008-2009 fiscal year pursuant to s.
23200.185(5)(a), Florida Statutes, or s. 200.186(1)(a), Florida
24Statutes, a municipality that, as a result of the application of
25the amendment to s. 200.185(1)(b), Florida Statutes, made by
26section 1, is no longer considered a municipality of special
27financial concern under s. 200.185, Florida Statutes, shall be
28treated as if the municipality had never been a municipality of
29special financial concern.
30     Section 3.  This act shall take effect November 1, 2007.
