3     Substitute Amendment for Amendment (177821) (with title

5Remove line(s) 56-165, and insert:
6of $70 million in fiscal year 2007-2008 and $100 million in each
7fiscal year thereafter, to be paid in quarterly installments and
8used as required by s. 403.890.
9     3.  The Grants and Donations Trust Fund in the Department
10of Community Affairs in the amount of $3.25 million in each
11fiscal year to be paid in monthly installments, with $3 million
12to be used to fund technical assistance to local governments and
13school boards on the requirements and implementation of this act
14and $250,000 to be used to fund the Century Commission
15established in s. 163.3247.

17Moneys distributed pursuant to this paragraph may not be pledged
18for debt service unless such pledge is approved by referendum of
19the voters.
20     Section 2.  Paragraph (b) of subsection (3) of section
21373.1961, Florida Statutes, is amended to read:
22     373.1961  Water production; general powers and duties;
23identification of needs; funding criteria; economic incentives;
24reuse funding.--
25     (3)  FUNDING.--
26     (b)  Beginning in fiscal year 2005-2006, the state shall
27annually provide a portion of those revenues deposited into the
28Water Protection and Sustainability Program Trust Fund for the
29purpose of providing funding assistance for the development of
30alternative water supplies pursuant to the Water Protection and
31Sustainability Program. At the beginning of each fiscal year,
32beginning with fiscal year 2005-2006, such revenues shall be
33distributed by the department into the alternative water supply
34trust fund accounts created by each district for the purpose of
35alternative water supply development under the following funding
36formula:
37     1.  Thirty percent to the South Florida Water Management
38District;
39     2.  Twenty-five percent to the Southwest Florida Water
40Management District;
41     3.  Twenty-five percent to the St. Johns River Water
42Management District;
43     4.  Ten percent to the Suwannee River Water Management
44District; and
45     5.  Ten percent to the Northwest Florida Water Management
46District.
47     Section 3.  Subsections (1) and (2) of section 403.890,
48Florida Statutes, are amended to read:
49     403.890  Water Protection and Sustainability Program;
50intent; goals; purposes.--
51     (1)  Effective July 1, 2006, revenues transferred from the
52Department of Revenue pursuant to s. 201.15(1)(d)2. shall be
53deposited into the Water Protection and Sustainability Program
54Trust Fund in the Department of Environmental Protection. These
55revenues and any other additional revenues deposited into or
56appropriated to the Water Protection and Sustainability Program
57Trust Fund shall be distributed by the Department of
58Environmental Protection in the following manner:
59     (a)  The sum of $42,750,000 in fiscal year 2007-2008 and 60
60sixty percent in each fiscal year thereafter to the Department
61of Environmental Protection for the implementation of an
62alternative water supply program as provided in s. 373.1961.
63     (b)  The sum of $7,250,000 in fiscal year 2007-2008 and 20
64twenty percent in each fiscal year thereafter for the
65implementation of best management practices and capital project
66expenditures necessary for the implementation of the goals of
67the total maximum daily loads program established in s. 403.067.
68Of these funds, $4,250,000 in fiscal year 2007-2008 and 85
69percent of such funds in each fiscal year thereafter shall be
70transferred to the credit of the Department of Environmental
71Protection Water Quality Assurance Trust Fund to address water
72quality impacts associated with nonagricultural nonpoint
73sources. Fifteen percent Of these funds, $3 million in fiscal
74year 2007-2008 and 15 percent of such funds in each fiscal year
75thereafter shall be transferred to the Department of Agriculture
76and Consumer Services General Inspection Trust Fund to address
77water quality impacts associated with agricultural nonpoint
78sources. These funds shall be used for research, development,
79demonstration, and implementation of the total maximum daily
80load program under s. 403.067, suitable best management
81practices or other measures used to achieve water quality
82standards in surface waters and water segments identified
83pursuant to s. 303(d) of the Clean Water Act, Pub. L. No. 92-
84500, 33 U.S.C. ss. 1251 et seq. Implementation of best
85management practices and other measures may include cost-share
86grants, technical assistance, implementation tracking, and
87conservation leases or other agreements for water quality
88improvement. The Department of Environmental Protection and the
89Department of Agriculture and Consumer Services may adopt rules
90governing the distribution of funds for implementation of
91capital projects, best management practices, and other measures.
92These funds shall not be used to abrogate the financial
93responsibility of those point and nonpoint sources that have
94contributed to the degradation of water or land areas. Increased
95priority shall be given by the department and the water
96management district governing boards to those projects that have
97secured a cost-sharing agreement allocating responsibility for
98the cleanup of point and nonpoint sources.
99     (c)  The sum of $10 million in fiscal year 2007-2008 and 10
100Ten percent in each fiscal year thereafter shall be disbursed
101for the purposes of funding projects pursuant to ss. 373.451-
102373.459 or surface water restoration activities in water-
103management-district-designated priority water bodies. The
104Secretary of Environmental Protection shall ensure that each
105water management district receives the following percentage of
106funds annually:
107     1.  Thirty-five percent to the South Florida Water
108Management District;
109     2.  Twenty-five percent to the Southwest Florida Water
110Management District;
111     3.  Twenty-five percent to the St. Johns River Water
112Management District;
113     4.  Seven and one-half percent to the Suwannee River Water
114Management District; and
115     5.  Seven and one-half percent to the Northwest Florida
116Water Management District.
117     (d)  The sum of $10 million in fiscal year 2007-2008 and 10
118Ten percent in each fiscal year thereafter
