20 | Section 2. Paragraph (b) of subsection (3) of section |
21 | 373.1961, Florida Statutes, is amended to read: |
22 | 373.1961 Water production; general powers and duties; |
23 | identification of needs; funding criteria; economic incentives; |
24 | reuse funding.-- |
25 | (3) FUNDING.-- |
26 | (b) Beginning in fiscal year 2005-2006, the state shall |
27 | annually provide a portion of those revenues deposited into the |
28 | Water Protection and Sustainability Program Trust Fund for the |
29 | purpose of providing funding assistance for the development of |
30 | alternative water supplies pursuant to the Water Protection and |
31 | Sustainability Program. At the beginning of each fiscal year, |
32 | beginning with fiscal year 2005-2006, such revenues shall be |
33 | distributed by the department into the alternative water supply |
34 | trust fund accounts created by each district for the purpose of |
35 | alternative water supply development under the following funding |
36 | formula: |
37 | 1. Thirty percent to the South Florida Water Management |
38 | District; |
39 | 2. Twenty-five percent to the Southwest Florida Water |
40 | Management District; |
41 | 3. Twenty-five percent to the St. Johns River Water |
42 | Management District; |
43 | 4. Ten percent to the Suwannee River Water Management |
44 | District; and |
45 | 5. Ten percent to the Northwest Florida Water Management |
46 | District. |
47 | Section 3. Subsections (1) and (2) of section 403.890, |
48 | Florida Statutes, are amended to read: |
49 | 403.890 Water Protection and Sustainability Program; |
50 | intent; goals; purposes.-- |
51 | (1) Effective July 1, 2006, revenues transferred from the |
52 | Department of Revenue pursuant to s. 201.15(1)(d)2. shall be |
53 | deposited into the Water Protection and Sustainability Program |
54 | Trust Fund in the Department of Environmental Protection. These |
55 | revenues and any other additional revenues deposited into or |
56 | appropriated to the Water Protection and Sustainability Program |
57 | Trust Fund shall be distributed by the Department of |
58 | Environmental Protection in the following manner: |
59 | (a) The sum of $42,750,000 in fiscal year 2007-2008 and 60 |
60 | sixty percent in each fiscal year thereafter to the Department |
61 | of Environmental Protection for the implementation of an |
62 | alternative water supply program as provided in s. 373.1961. |
63 | (b) The sum of $7,250,000 in fiscal year 2007-2008 and 20 |
64 | twenty percent in each fiscal year thereafter for the |
65 | implementation of best management practices and capital project |
66 | expenditures necessary for the implementation of the goals of |
67 | the total maximum daily loads program established in s. 403.067. |
68 | Of these funds, $4,250,000 in fiscal year 2007-2008 and 85 |
69 | percent of such funds in each fiscal year thereafter shall be |
70 | transferred to the credit of the Department of Environmental |
71 | Protection Water Quality Assurance Trust Fund to address water |
72 | quality impacts associated with nonagricultural nonpoint |
73 | sources. Fifteen percent Of these funds, $3 million in fiscal |
74 | year 2007-2008 and 15 percent of such funds in each fiscal year |
75 | thereafter shall be transferred to the Department of Agriculture |
76 | and Consumer Services General Inspection Trust Fund to address |
77 | water quality impacts associated with agricultural nonpoint |
78 | sources. These funds shall be used for research, development, |
79 | demonstration, and implementation of the total maximum daily |
80 | load program under s. 403.067, suitable best management |
81 | practices or other measures used to achieve water quality |
82 | standards in surface waters and water segments identified |
83 | pursuant to s. 303(d) of the Clean Water Act, Pub. L. No. 92- |
84 | 500, 33 U.S.C. ss. 1251 et seq. Implementation of best |
85 | management practices and other measures may include cost-share |
86 | grants, technical assistance, implementation tracking, and |
87 | conservation leases or other agreements for water quality |
88 | improvement. The Department of Environmental Protection and the |
89 | Department of Agriculture and Consumer Services may adopt rules |
90 | governing the distribution of funds for implementation of |
91 | capital projects, best management practices, and other measures. |
92 | These funds shall not be used to abrogate the financial |
93 | responsibility of those point and nonpoint sources that have |
94 | contributed to the degradation of water or land areas. Increased |
95 | priority shall be given by the department and the water |
96 | management district governing boards to those projects that have |
97 | secured a cost-sharing agreement allocating responsibility for |
98 | the cleanup of point and nonpoint sources. |
99 | (c) The sum of $10 million in fiscal year 2007-2008 and 10 |
100 | Ten percent in each fiscal year thereafter shall be disbursed |
101 | for the purposes of funding projects pursuant to ss. 373.451- |
102 | 373.459 or surface water restoration activities in water- |
103 | management-district-designated priority water bodies. The |
104 | Secretary of Environmental Protection shall ensure that each |
105 | water management district receives the following percentage of |
106 | funds annually: |
107 | 1. Thirty-five percent to the South Florida Water |
108 | Management District; |
109 | 2. Twenty-five percent to the Southwest Florida Water |
110 | Management District; |
111 | 3. Twenty-five percent to the St. Johns River Water |
112 | Management District; |
113 | 4. Seven and one-half percent to the Suwannee River Water |
114 | Management District; and |
115 | 5. Seven and one-half percent to the Northwest Florida |
116 | Water Management District. |
117 | (d) The sum of $10 million in fiscal year 2007-2008 and 10 |
118 | Ten percent in each fiscal year thereafter |
