4 | Section 1. Subsection (1), paragraph (a) of subsection |
5 | (2), paragraph (a) of subsection (10), and subsections (12) and |
6 | (14) of section 1004.445, Florida Statutes, are amended to read: |
7 | 1004.445 Ronald Reagan Johnnie B. Byrd, Sr., Alzheimer's |
8 | Center and Research Institute.-- |
9 | (1) The Ronald Reagan Johnnie B. Byrd, Sr., Alzheimer's |
10 | Center and Research Institute is established at the University |
11 | of South Florida. |
12 | (2)(a) The State Board of Education shall enter into an |
13 | agreement for the utilization of the facilities on the campus of |
14 | the University of South Florida to be known as the Ronald Reagan |
15 | Johnnie B. Byrd, Sr., Alzheimer's Center and Research Institute, |
16 | including all furnishings, equipment, and other chattels used in |
17 | the operation of those facilities, with a Florida not-for-profit |
18 | corporation organized solely for the purpose of governing and |
19 | operating the Ronald Reagan Johnnie B. Byrd, Sr., Alzheimer's |
20 | Center and Research Institute. This not-for-profit corporation, |
21 | acting as an instrumentality of the state, shall govern and |
22 | operate the Ronald Reagan Johnnie B. Byrd, Sr., Alzheimer's |
23 | Center and Research Institute in accordance with the terms of |
24 | the agreement between the State Board of Education and the not- |
25 | for-profit corporation. The not-for-profit corporation may, with |
26 | the prior approval of the Board of Governors, create either for- |
27 | profit or not-for-profit corporate subsidiaries, or both, to |
28 | fulfill its mission. The not-for-profit corporation and its |
29 | subsidiaries are authorized to receive, hold, invest, and |
30 | administer property and any moneys acquired from private, local, |
31 | state, and federal sources, as well as technical and |
32 | professional income generated or derived from practice |
33 | activities of the institute, for the benefit of the institute |
34 | and the fulfillment of its mission. Effective July 1, 2007, the |
35 | agreement authority provided to the State Board of Education is |
36 | transferred to the Board of Governors. |
37 | (10) The following information is confidential and exempt |
38 | from s. 119.07(1) and s. 24, Art. I of the State Constitution: |
39 | (a) Personal identifying information relating to clients |
40 | of programs created or funded through the Ronald Reagan Johnnie |
41 | B. Byrd, Sr., Alzheimer's Center and Research Institute that is |
42 | held by the institute, the University of South Florida, the |
43 | Board of Governors, or the State Board of Education; |

45 | Any governmental entity that demonstrates a need to access such |
46 | confidential and exempt information in order to perform its |
47 | duties and responsibilities shall have access to such |
48 | information. |
49 | (12) Beginning in fiscal year 2007-2008 2006-2007, the sum |
50 | of $7.5 $15 million is appropriated annually from recurring |
51 | funds in the General Revenue Fund to the Grants and Donations |
52 | Trust Fund within the Department of Elderly Affairs for the |
53 | Ronald Reagan Johnnie B. Byrd, Sr., Alzheimer's Center and |
54 | Research Institute at the University of South Florida for the |
55 | purposes as provided under paragraph (6)(a), conducting and |
56 | supporting research, providing institutional research grants and |
57 | investigator-initiated research grants, developing and operating |
58 | integrated data projects, and providing assistance to |
59 | statutorily designated memory disorder clinics as provided under |
60 | s. 430.502. Not less than 80 percent of the appropriated funds |
61 | shall be expended for these purposes, and not less than 20 |
62 | percent of the appropriated funds shall be expended for peer- |
63 | reviewed investigator-initiated research grants. |
64 | (14) The Legislature shall review the performance, the |
65 | outcomes, and the financial management of the Ronald Reagan |
66 | Johnnie B. Byrd, Sr., Alzheimer's Center and Research Institute |
67 | during the 2010 Regular Session of the Legislature and shall |
68 | determine the most appropriate funding source and means of |
69 | funding the center and institute based on its review. |
70 | Section 2. This act shall take effect upon becoming a law. |
