13 Senate Amendment (with title amendment)
14 On page 4, line 15, through
15 page 5, line 23, delete those lines
16
17 and insert:
18 (c) All residential and commercial property persons
19 entitled to a homestead exemption under Section 6 of this
20 Article shall be have their homestead assessed at just value
21 as of January 1 of the year following the effective date of
22 this amendment. This assessment shall change only as provided
23 herein.
24 (1) Assessments subject to this provision shall be
25 changed annually on January 1st of each year; but those
26 changes in assessments shall not exceed the lower of the
27 following:
28 a. Three percent (3%) of the assessment for the prior
29 year.
30 b. The percent change in the Consumer Price Index for
31 all urban consumers, U.S. City Average, all items 1967=100, or

1 successor reports for the preceding calendar year as initially
2 reported by the United States Department of Labor, Bureau of
3 Labor Statistics.
4 (2) No assessment shall exceed just value.
5 (3) After any change of ownership, as provided by
6 general law, residential and commercial homestead property
7 shall be assessed at just value as of January 1 of the
8 following year, unless the provisions of paragraph (7) apply.
9 Thereafter, the property homestead shall be assessed as
10 provided herein.
11 (4) New residential and commercial homestead property
12 shall be assessed at just value as of January 1st of the year
13 following the completion of construction establishment of the
14 property, unless the provisions of paragraph (7) apply
15 homestead. That assessment shall only change as provided
16 herein.
17 (5) Changes, additions, reductions, or improvements to
18 residential property or commercial homestead property shall be
19 assessed as provided for by general law; provided, however,
20 after the adjustment for any change, addition, reduction, or
21 improvement, the property shall be assessed as provided
22 herein.
23 (6) In the event of a termination of homestead status,
24 the property shall be assessed as provided by general law.
25 (6)(7) The provisions of this amendment are severable.
26 If any of the provisions of this amendment shall be held
27 unconstitutional by any court of competent jurisdiction, the
28 decision of such court shall not affect or impair any
29 remaining provisions of this amendment.
