  1                      A bill to be entitled
  2         An act relating to a special election;
  3         providing for a special election to be held
  4         January 29, 2008, pursuant to Section 5 of
  5         Article XI of the State Constitution, for the
  6         approval or rejection by the electors of this
  7         state of amendments to the State Constitution,
  8         proposed by joint resolution, relating to an
  9         exemption from ad valorem taxation for tangible
10         personal property, the transfer of the accrued
11         benefit from the limitation on assessed value
12         of homestead property, the assessment of
13         rent-restricted affordable housing and
14         commercial and public-access waterfront
15         property, an increase in the homestead
16         exemption, an additional homestead exemption
17         for first-time homestead property owners, a
18         complete homestead exemption for low-income
19         seniors, a limitation on the authority of a
20         county, municipality, or special district to
21         increase ad valorem taxes, a requirement for
22         each county to have an elected property
23         appraiser, and an effective date if such
24         amendments are adopted; providing for
25         publication of notice and for procedures;
26         providing an appropriation; providing a
27         contingent effective date.

29  Be It Enacted by the Legislature of the State of Florida:

 1         Section 1.  Pursuant to Section 5 of Article XI of the
 2  State Constitution, there shall be a special election on
 3  January 29, 2008, to be held concurrently with other statewide
 4  elections held on that date, if any, at which there shall be
 5  submitted to the electors of this state for approval or
 6  rejection the amendments to the State Constitution proposed in
 7  Senate Joint Resolution 2-D or House Joint Resolution 7001-D,
 8  2007D Special Session.
 9         Section 2.  Publication of notice shall be in
10  accordance with Section 5 of Article XI of the State
11  Constitution. The special election shall be held as other
12  special elections are held.
13         Section 3.  The sum of $560,000 in nonrecurring funds
14  from the General Revenue Fund is appropriated to the
15  Department of State for the 2007-2008 fiscal year for the
16  purpose of advertising the constitutional amendments being
17  submitted to the electors of this state at the special
18  election called by this act.
19         Section 4.  This act shall take effect upon becoming a
20  law if enacted by a vote of at least three-fourths of the
21  membership of each house of the Legislature and if Senate
22  Joint Resolution 2-D or House Joint Resolution 7001-D, 2007D
23  Special Session, is adopted by both houses of the Legislature.
