SB 6-D Second Engrossed
1 A bill to be entitled
2 An act relating to a special election;
3 providing for a special election to be held
4 January 29, 2008, pursuant to Section 5 of
5 Article XI of the State Constitution, for the
6 approval or rejection by the electors of this
7 state of amendments to the State Constitution,
8 proposed by joint resolution, relating to an
9 exemption from ad valorem taxation for tangible
10 personal property, the transfer of the accrued
11 benefit from the limitation on assessed value
12 of homestead property, a limitation on annual
13 assessment increases for specified real
14 property, an increase in the homestead
15 exemption, and an effective date if such
16 amendments are adopted; providing for
17 publication of notice and for procedures;
18 providing an appropriation; providing a
19 contingent effective date.

21 Be It Enacted by the Legislature of the State of Florida:

23 Section 1. Pursuant to Section 5 of Article XI of the
24 State Constitution, there shall be a special election on
25 January 29, 2008, to be held concurrently with other statewide
26 elections held on that date, if any, at which there shall be
27 submitted to the electors of this state for approval or
28 rejection the amendments to the State Constitution proposed in
29 Senate Joint Resolution 2-D or House Joint Resolution 7001-D,
30 2007D Special Session.

1 Section 2. Publication of notice shall be in
2 accordance with Section 5 of Article XI of the State
3 Constitution. The special election shall be held as other
4 special elections are held.
5 Section 3. The sum of $560,000 in nonrecurring funds
6 from the General Revenue Fund is appropriated to the
7 Department of State for the 2007-2008 fiscal year for the
8 purpose of advertising the constitutional amendments being
9 submitted to the electors of this state at the special
10 election called by this act.
11 Section 4. This act shall take effect upon becoming a
12 law if enacted by a vote of at least three-fourths of the
13 membership of each house of the Legislature and if Senate
14 Joint Resolution 2-D or House Joint Resolution 7001-D, 2007D
15 Special Session, is adopted by both houses of the Legislature.
