| 5 | Section 1. Subsection (1) of section 103.101, Florida |
| 6 | Statutes, is amended to read: |
| 7 | 103.101 Presidential preference primary.-- |
| 8 | (1) Each political party other than a minor political |
| 9 | party shall, on the first last Tuesday in February January in |
| 10 | each year the number of which is a multiple of 4, elect one |
| 11 | person to be the candidate for nomination of such party for |
| 12 | President of the United States or select delegates to the |
| 13 | national nominating convention, as provided by party rule. |
| 14 | Section 2. Pursuant to Section 5 of Article XI of the |
| 15 | State Constitution, there shall be a special election on |
| 16 | February 5, 2008, to be held concurrently with other statewide |
| 17 | elections held on that date, if any, at which there shall be |
| 18 | submitted to the electors of this state for approval or |
| 19 | rejection the amendments to the State Constitution proposed in |
| 20 | Senate Joint Resolution 2-D or House Joint Resolution 7001D, |
| 21 | 2007D Special Session. |
| 22 | Section 3. Publication of notice shall be in accordance |
| 23 | with Section 5 of Article XI of the State Constitution. The |
| 24 | special election shall be held as other special elections are |
| 25 | held. |
| 26 | Section 4. Notwithstanding any other provision of law, any |
| 27 | requirements or prerequisites imposed upon any state, county, |
| 28 | municipal, or other governmental entity or political party |
| 29 | relating to the January 29, 2008, presidential preference |
| 30 | primary shall be deemed met and satisfied for purposes of the |
| 31 | presidential preferential primary held on February 5, 2008, |
| 32 | pursuant to this act. |
