4     Between lines 74-75, insert:
5     Section 3.  Subsection (1) of section 627.091, Florida
6Statutes, is amended to read:
7     627.091  Rate filings; workers' compensation and employer's
8liability insurances.--
9     (1)  As to workers' compensation and employer's liability
10insurances, every insurer shall file with the office every
11manual of classifications, rules, and rates, every rating plan,
12and every modification of any of the foregoing which it proposes
13to use. Every insurer is authorized to include deductible and
14composite rating provisions in its manual of classifications,
15rules, and rates. An insurer may file a rating plan that
16aggregates payrolls for workers' compensation coverage under an
17owner-controlled insurance program for both private and public
18entities to meet minimum deductible and premium requirements.
19For purposes of this section, the term "owner-controlled
20insurance program" means a consolidated insurance program or
21series of insurance policies issued to an entity that may
22provide one or more of the following types of insurance coverage
23for any contractor or subcontractor working at specified or
24multiple contracted work sites of a construction project:
25general liability, property damage excluding damage to real
26property, workers' compensation, or employer's liability. Such
27deductibles shall in all cases be in a form and manner which is
28consistent with the underlying purpose of chapter 440.
