2An act relating to motor vehicle license plates; amending
3ss. 320.08056 and 320.08058, F.S.; creating a Confederate
4Heritage license plate; establishing an annual use fee for
5the plate; providing for the distribution of use fees
6received from the sale of such plates; amending s.
7320.0841, F.S.; providing for issuance of free license
8plates to members of the Choctaw Indian Tribe; providing
9an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Paragraph (mmm) is added to subsection (4) of
14section 320.08056, Florida Statutes, to read:
15     320.08056  Specialty license plates.--
16     (4)  The following license plate annual use fees shall be
17collected for the appropriate specialty license plates:
18     (mmm)  Confederate Heritage license plate, $25.
19     Section 2.  Subsection (65) is added to section 320.08058,
20Florida Statutes, to read:
21     320.08058  Specialty license plates.--
22     (65)  CONFEDERATE HERITAGE LICENSE PLATES.--
23     (a)  The department shall develop a Confederate Heritage
24license plate as provided in this section. Confederate Heritage
25license plates must bear the colors and design approved by the
26department and must contain an emblem or logo of Florida's
27historic Confederate flags and facsimiles of the buttons issued
28to Florida Confederate units. The word "Florida" must appear at
29the top of the plate, and the words "Confederate Heritage" must
30appear at the bottom of the plate.
31     (b)  The license plate annual use fees shall be distributed
32to Sons of Confederate Veterans, Florida Division, Inc., to fund
33educational programs in schools, cemetery location and
34restoration, educational scholarship programs, and other
35projects within the state promoting Florida's history and
36heritage. Sons of Confederate Veterans, Florida Division, Inc.,
37may retain all revenue from the annual use fees until all
38startup costs for developing and establishing the plate have
39been recovered. Thereafter, up to 5 percent of the annual use
40fee revenue may be used for administrative costs directly
41associated with operations of Sons of Confederate Veterans,
42Florida Division, Inc., and up to 20 percent may be used for
43promotion and marketing of the specialty license plate.
44     Section 3.  Section 320.0841, Florida Statutes, is amended
45to read:
46     320.0841  Free motor vehicle license plates to members of
47Choctaw, Seminole, and Miccosukee Indian Tribes.--
48     (1)  The department shall issue each year, free of charge
49to any state agency or individual, a sufficient number of motor
50vehicle license plates for use on vehicles owned and operated by
51members of the Choctaw, Seminole, and Miccosukee Indian Tribes.
52The allocation for any year may be increased by an amount equal
53to up to 10 percent of the allocation for the previous year. Any
54request for such increase shall be accompanied by formal
55certification of the need therefor by the Choctaw, Seminole, or
56and Miccosukee Tribal Council, as appropriate Councils.
57     (2)  The department shall provide an appropriate
58application form and procedures for request and issuance of the
59license plates.
60     Section 4.  This act shall take effect July 1, 2008.
